Common use of Amended Lease Clause in Contracts

Amended Lease. If: (i) Tenant fails to timely deliver a Tenant Expansion Exercise Notice or an Acceptance Notice, as applicable, within the time periods provided in Section 39(a), or (ii) after the expiration of a period of 10 days from the date that Landlord delivers to Tenant a lease amendment, which lease amendment shall include a work letter, for the Available Space, no lease amendment for the Available Space has been mutually executed, Tenant shall be deemed to have waived its right to lease such Available Space.

Amended Lease. If: (i) Tenant fails to timely deliver a Tenant notice accepting the terms of an Expansion Exercise Notice or an Acceptance Notice, as applicable, within the time periods provided in Section 39(a), or (ii) after the expiration of a period of 10 30 days from the date that Landlord delivers Tenant gives notice accepting Landlord’s offer to Tenant a lease amendment, which lease amendment shall include a work letter, for the such Available Space, no lease amendment or lease agreement for the Available Space on terms which are consistent with those set forth in the Expansion Notice has been mutually executed, Tenant shall be deemed to have waived its right to lease such Available Space.

If: (i) Tenant fails to timely deliver a Tenant Expansion an Exercise Notice or an Acceptance Notice, as applicable, within the time periods provided in Section 39(a), or (ii) after following Tenant’s delivery of an exercise notice to Landlord, Landlord tenders to Tenant an amendment to the expiration Lease for the rental of a period of the Identified Expansion Space reasonably acceptable to Landlord and Tenant, each in their reasonable discretion, and Tenant fails to execute such Lease amendment within 10 days from the date that Landlord delivers to Tenant a lease amendment, which lease amendment shall include a work letter, for the Available Space, no lease amendment for the Available Space has been mutually executedfollowing such tender, Tenant shall be deemed to have waived its right to lease such Available the Identified Expansion Space.
