Common use of Amended Lease Clause in Contracts

Amended Lease. If: (i) Tenant fails to timely deliver an Exercise Notice, or (ii) after the expiration of a period of 10 days from the date Tenant gives notice accepting Landlord’s offer to lease such Identified Available Space, no lease amendment or lease agreement for the Identified Available Space has been executed, and Landlord tenders to Tenant an amendment to this Lease setting forth the terms for the rental of the Identified Available Space consistent with those set forth in the Expansion Notice and otherwise consistent with the terms of this Lease and Tenant fails to execute such Lease amendment within 10 business days following such tender, Tenant shall be deemed to have forever waived its right to lease such Identified Available Space.

If: (i) Tenant fails to timely deliver notice accepting the terms of an Exercise Expansion Notice, or (ii) after the expiration of a period of 10 30 days from the date Tenant gives notice accepting Landlord’s 's offer to lease such Identified Available Space, no lease amendment or lease agreement for the Identified Available Space has been executed, and Landlord tenders to Tenant an amendment to this Lease setting forth the terms for the rental of the Identified Available Space consistent with those set forth in the Expansion Notice and otherwise consistent with the terms of this Lease and Tenant fails to execute such Lease amendment within 10 business days following such tender, Tenant shall be deemed to have forever waived its right to lease such Identified Available Space.

If: (i) Tenant fails to timely deliver notice accepting the terms of an Exercise Expansion Notice, or (ii) after the expiration of a period of 10 30 days from the date Tenant gives notice accepting Landlord’s offer to lease such Identified Available Expansion Space, no lease amendment or lease agreement for the Identified Available Expansion Space has been executed, and Landlord tenders to Tenant an amendment to this Lease setting forth the terms for the rental of the Identified Available Expansion Space consistent with those set forth in the Expansion Notice and otherwise consistent with the terms of this Lease and Tenant fails to execute such Lease amendment within 10 business days following such tender, Tenant shall be deemed to have forever waived its right to lease such Identified Available Expansion Space.

If: (i) Tenant fails to timely deliver notice accepting the terms of an Exercise Expansion Notice, or (ii) after the expiration of a period of 10 30 days from the date Tenant gives notice accepting Landlord’s offer to lease such Identified the Available Space, no lease amendment or lease agreement for the Identified Available Space has been executed, and Landlord tenders to Tenant an amendment (*n form and substance reasonably acceptable to Landlord and Tenant) to this Lease setting forth the terms for the rental of the Identified Available Space consistent with those set forth in the Expansion Notice and otherwise consistent with the terms of this Lease and Tenant fails to execute such Lease amendment within 10 business days following after such tender, Tenant shall be deemed to have forever waived its right to lease such Identified the specific Available SpaceSpace in question.

Amended Lease. If: (i) Tenant fails to timely deliver notice accepting the terms of an Exercise Expansion Notice, or (ii) after the expiration of a period of 10 15 days from the date Tenant gives notice accepting Landlord’s offer to lease such Identified Available Space, no lease amendment or lease agreement for the Identified Available Space has been executed, and Landlord tenders to Tenant an amendment to this Lease setting forth the terms for the rental of the Identified Available Space consistent with those set forth in the Expansion Notice and otherwise consistent with the terms of this Lease and Tenant fails to execute such Lease amendment within 10 5 business days following such tender, Tenant shall be deemed to have forever waived its right to lease such Identified the Available SpaceSpace and Tenant shall have no further rights under this Section 36.
