Common use of Amended Lease Clause in Contracts

Amended Lease. If: (i) Tenant fails to timely deliver a Space Acceptance Notice, or (ii) after the expiration of a period of 10 days after Landlord’s delivery to Tenant of a lease amendment or lease agreement for Tenant’s lease of the Available Space, no lease amendment or lease agreement for the Available Space acceptable to both parties each in their sole and absolute discretion, has been executed, Tenant shall be deemed to have waived its right to lease such Available Space.

Amended Lease. If: If (i) Tenant fails to timely deliver a Space Acceptance Notice, or (ii) after the expiration of a period of 10 days after Landlord’s delivery to Tenant of a lease amendment or lease agreement for Tenant’s lease of the Available Identified Space, no lease amendment or lease agreement for the Available Identified Space acceptable to both parties each in their sole and absolute discretion, has been executed, Tenant shall be deemed to have waived its right to lease such Available Identified Space.

Amended Lease. If: (i) Tenant fails to timely deliver a Space Acceptance the Exercise Notice, or (ii) after the expiration of a period of 10 30 days after Landlord’s delivery to Tenant of a lease amendment or lease agreement for Tenant’s lease of the Available Identified Space, no lease amendment or lease agreement for the Available Identified Space acceptable to both parties each in their sole and absolute discretionreasonable discretion after using diligent good faith efforts negotiate the same, has been executed, Tenant shall shall, notwithstanding anything to the contrary contained herein, be deemed to have forever waived its right to lease such Available Identified Space.

If: (i) Tenant fails to timely deliver a Space Acceptance Notice, or (ii) after the expiration of a period of 10 15 days after Landlord’s delivery to Tenant of a lease amendment or lease agreement for Tenant’s lease of the Available First Refusal Space, no lease amendment or lease agreement for the Available First Refusal Space acceptable to both parties each in their sole and absolute discretion, has been executed, Tenant shall shall, notwithstanding anything to the contrary contained herein, be deemed to have forever waived its right to lease such Available First Refusal Space.

Amended Lease. If: (i) Tenant fails to timely deliver a Space Acceptance Notice, or (ii) after the expiration of a period of 10 days after Landlord’s delivery to Tenant of a lease amendment or lease agreement for Tenant’s lease of the Available Identified Space, no lease amendment or lease agreement for the Available Identified Space acceptable to both parties each in their sole and absolute discretion, discretion has been executed, Tenant shall be deemed to have waived its right to lease such Available SpaceIdentified Space (subject to the terms of Section 39(a) above).

If: (i) Tenant fails to timely deliver a Space an Acceptance Notice, or (ii) after the expiration of a period of 10 120 days after Landlord’s delivery to Tenant of a lease amendment or lease agreement for Tenant’s lease of the Available Identified Space, no lease amendment or lease agreement for the Available Identified Space acceptable to both parties each in their sole and absolute discretionreasonable discretion after using diligent good faith efforts negotiate the same, has been executed, Tenant shall shall, notwithstanding anything to the contrary contained herein, be deemed to have forever waived its right to lease such Available Identified Space.

If: If (i) Tenant fails to timely deliver a Space Acceptance Notice, or (ii) after the expiration of a period of 10 business days after Landlord’s delivery to Tenant of a lease amendment or lease agreement for Tenant’s lease of the Available Identified Space, no lease amendment or lease agreement for the Available Identified Space acceptable to both parties each in their sole and absolute discretion, has been executed, Tenant shall be deemed to have waived its right to lease such Available the Identified Space, subject to the terms of Section 39(a) above.
