Common use of Allowance Clause in Contracts

Allowance. Tenant shall be entitled to a one-time tenant improvement allowance (the “Allowance”) in the amount of $55,836.00 to be applied toward the Allowance Items (defined in Section 1.2 below). Tenant shall be responsible for all costs associated with the Tenant Improvement Work, including the costs of the Allowance Items, to the extent such costs exceed the lesser of (a) the Allowance, or (b) the aggregate amount that Landlord is required to disburse for such purpose pursuant to this Expansion Work Letter. Notwithstanding any contrary provision of this Agreement, if Tenant fails to use the entire Allowance by December 31, 2010, then up to $15,510.00 of such unused amount shall be applied by Landlord to Base Rent next coming due under the Lease, and any further remainder shall revert to Landlord and Tenant shall have no further rights with respect thereto.

Allowance. Tenant shall be entitled to a one-time tenant improvement allowance (the “Allowance”) in the amount of $55,836.00 4,159,870.00 to be applied toward the Allowance Items (defined in Section 1.2 below). Tenant shall be responsible for all costs associated with the Tenant Improvement Work, including the costs of the Allowance Items, to the extent such costs exceed the lesser of (a) the Allowance, or (b) the aggregate amount that Landlord is required to disburse for such purpose pursuant to this Expansion Work Letter. Notwithstanding any contrary provision of this Agreementhereof, if Tenant fails to use the entire Allowance by December 31April 30, 20102011, then up to $15,510.00 of such the unused amount shall be applied by Landlord to Base Rent next coming due under the Lease, and any further remainder shall revert to Landlord and Tenant shall have no further rights with respect thereto.

Allowance. Tenant shall be entitled to a one-time tenant improvement allowance (for purposes of this Exhibit B, the “Allowance”) in the amount of $55,836.00 9,782.50 to be applied toward (i) the Allowance Items (defined in Section 1.2 below), and (ii) Security System Costs, as more fully provided in Section 7.5 of the Agreement. Tenant shall be responsible for all costs associated with the Tenant Improvement Work, including the costs of the Allowance Items, to the extent such costs exceed the lesser of (a) the Allowance, or (b) the aggregate amount that Landlord is required to disburse for such purpose pursuant to this Expansion Work Letter. Notwithstanding any contrary provision of this Agreement, if Tenant fails to use the entire Allowance by December 31November 30, 20102011, then up to $15,510.00 of such the unused amount shall be applied by Landlord to Base Rent next coming due under the Lease, and any further remainder shall revert to Landlord and Tenant shall have no further rights with respect thereto.

Allowance. Tenant shall be entitled to a one-time tenant improvement allowance (the “Allowance”) in the amount of $55,836.00 10.00 per rentable square foot of the Premises to be applied toward the Allowance Items (defined in Section 1.2 below). Tenant shall be responsible for all costs associated with the Tenant Improvement Work, including the costs of the Allowance Items, to the extent such costs exceed the lesser of (a) the Allowance, or (b) the aggregate amount that Landlord is required to disburse for such purpose pursuant to this Expansion Work Letter. Notwithstanding any contrary provision of this Agreement, if Tenant fails to use the entire Allowance by December March 31, 20102019, then up to $15,510.00 of such the unused amount shall be applied by Landlord to Base Rent next coming due under the Lease, and any further remainder shall revert to Landlord and Tenant shall have no further rights with respect thereto.

Allowance. Tenant shall be entitled to a one-time tenant improvement allowance (the “Allowance”) in the amount of $55,836.00 2,422,440.00 to be applied toward the Allowance Items (defined in Section 1.2 below). Tenant shall be responsible for all costs associated with the Tenant Improvement Work, including the costs of the Allowance Items, to the extent such costs exceed the lesser of (a) the Allowance, or (b) the aggregate amount that Landlord is required to disburse for such purpose pursuant to this Expansion Work Letter. Notwithstanding any contrary provision of this Agreement, if Tenant fails to use the entire Allowance by December 31, 20102012, then up to $15,510.00 of such the unused amount shall be applied by Landlord to Base Rent next coming due under the Lease, and any further remainder shall revert to Landlord and Tenant shall have no further rights with respect thereto.

Allowance. Tenant shall be entitled to a one-time tenant improvement allowance (the “Allowance”) in the amount of $55,836.00 7,903,875.00 to be applied toward the Allowance Items (defined in Section 1.2 below). Tenant shall be responsible for all costs associated with the Tenant Improvement Work, including the costs of the Allowance Items, to the extent such costs exceed the lesser of (a) the Allowance, or (b) the aggregate amount that Landlord is required to disburse for such purpose pursuant to this Expansion Work Letter. Notwithstanding any contrary provision of this Agreement, if Tenant fails to use the entire Allowance by December 31November 30, 20102018, then up to $15,510.00 of such the unused amount shall be applied by Landlord to Base Rent next coming due under the Lease, and any further remainder shall revert to Landlord and Tenant shall have no further rights with respect thereto.

Allowance. Tenant shall be entitled to a one-time tenant improvement allowance (for the purposes of this Exhibit A, the “Allowance”) in the amount of $55,836.00 31,840.00 to be applied toward the Allowance Items (defined in Section 1.2 below). Tenant shall be responsible for all costs associated with the Tenant Improvement Work, including the costs of the Allowance Items, to the extent such costs exceed the lesser of (a) the Allowance, or (b) the aggregate amount that Landlord is required to disburse for such purpose pursuant to this Expansion Extension Work Letter. Notwithstanding any contrary provision of this Agreement, if Tenant fails to use the entire Allowance by December 31November 30, 20102024, then up to $15,510.00 of such the unused amount shall be applied by Landlord to Base Rent next coming due under the Lease, and any further remainder shall revert to Landlord and Tenant shall have no further rights with respect thereto.

Allowance. Tenant shall be entitled to a one-time tenant improvement allowance (the “Allowance”) in the amount of $55,836.00 190,665.00 to be applied toward the Allowance Items (defined in Section 1.2 below). Tenant shall be responsible for all costs associated with the Tenant Improvement Work, including the costs of the Allowance Items, to the extent such costs exceed the lesser of (a) the Allowance, or (b) the aggregate amount that Landlord is required to disburse for such purpose pursuant to this Expansion Work Letter. Notwithstanding any contrary provision of this Agreement, if Tenant fails to use the entire Allowance by December 31, 20102012, then up to $15,510.00 of such the unused amount shall be applied by Landlord to Base Rent next coming due under the Lease, and any further remainder shall revert to Landlord and Tenant shall have no further rights with respect thereto.

Allowance. Tenant shall be entitled to a one-time tenant improvement allowance (for purposes of this Exhibit B, the “Allowance”) in the amount of $55,836.00 200,000.00 to be applied toward the Allowance Items (defined in Section 1.2 below). Tenant shall be responsible for all costs associated with the Tenant Improvement Work, including the costs of the Allowance Items, to the extent such costs exceed the lesser of (a) the Allowance, or (b) the aggregate amount that Landlord is required to disburse for such purpose pursuant to this Expansion Extension Work Letter. Notwithstanding any contrary provision of this Agreement, if Tenant fails to use the entire Allowance by December 31, 20102019, then up to $15,510.00 of such the unused amount shall be applied by Landlord to Base Rent next coming due under the Lease, and any further remainder shall revert to Landlord and Tenant shall have no further rights with respect thereto.

Allowance. Tenant shall be entitled to a one-time tenant improvement allowance (the “Allowance”) in the amount of $55,836.00 3,000,260.00 to be applied toward the Allowance Items (defined in Section 1.2 3.2 below). Tenant shall be responsible for all costs associated with the Tenant Improvement Work, including the costs of the Allowance Items, to the extent such costs exceed the lesser of (a) the Allowance, or (b) the aggregate amount that Landlord is required to disburse for such purpose pursuant to this Expansion Work Letter. Notwithstanding any contrary provision of this Agreement, if Tenant fails to use the entire Allowance by December 31on or before February 28, 20102019, then up to $15,510.00 of such the unused amount shall be applied by Landlord to Base Rent next coming due under the Lease, and any further remainder shall revert to Landlord and Tenant shall have no further rights with respect thereto.

Allowance. Tenant shall be entitled to a one-time tenant improvement allowance (the “Allowance”) in the amount of $55,836.00 15.12 per rentable square foot of the Premises to be applied toward the Allowance Items (defined in Section 1.2 below). Tenant shall be responsible for all costs associated with the Tenant Improvement Work, including the costs of the Allowance Items, to the extent such costs exceed the lesser of (a) the Allowance, or (b) the aggregate amount that Landlord is required to disburse for such purpose pursuant to this Expansion Work Letter. Notwithstanding any contrary provision of this Agreement, if Tenant fails to use the entire Allowance by December March 31, 20102012, then up to $15,510.00 of such the unused amount shall be applied by Landlord to Base Rent next coming due under the Lease, and any further remainder shall revert to Landlord and Tenant shall have no further rights with respect thereto.

Allowance. Tenant shall be entitled to a one-time tenant improvement allowance (the “Allowance”) in the amount of $55,836.00 10.00 per rentable square fool of the Premises to be applied toward the Allowance Items items (defined in Section 1.2 below). Tenant shall be responsible for all costs associated with the Tenant Improvement improvement Work, including the costs of the Allowance Items, to the extent such costs exceed the lesser of (a) the Allowance, or (b) the aggregate amount that Landlord is required to disburse for such purpose pursuant to this Expansion Work Letter. Notwithstanding any contrary provision of this Agreement, if Tenant fails to use the entire Allowance by December 31within one (1) year following the Premises Delivery Date, 2010, then up to $15,510.00 of such the unused amount shall be applied by Landlord to Base Rent next coming due under the Lease, and any further remainder shall revert to Landlord and Tenant shall have no further rights with respect thereto.
