Common use of Allocation of Interruptible Water Clause in Contracts

Allocation of Interruptible Water. Each year from water sources available to the project, the State shall make available and allocate interruptible water to contractors in accordance with the procedure in Article 18(a). Allocations of interruptible water in any one year may not be carried over for delivery in a subsequent year, nor shall the delivery of interruptible water in any year impact a contractor’s approved deliveries of annual entitlement or the contractor’s allocation of water for the next year. Deliveries of interruptible water in excess of a contractor’s annual entitlement may be made if the deliveries do not adversely affect the State’s delivery of annual entitlement to other contractors or adversely affect project operations. Any amounts of water owed to the Agency as of the date of this amendment pursuant to former Article 12(d), any contract provisions or letter agreements relating to wet weather water, and any Article 14(b) balances accumulated prior to 1995, are canceled. The State shall hereafter use its best efforts, in a manner that causes no adverse impacts upon other contractors or the project, to avoid adverse economic impacts due to a contractor’s inability to take water during wet weather.
