Common use of Allegations Clause in Contracts

Allegations. This Settlement Agreement settles Notice of Violation (NOV) CP21- 06-02 which was issued on June 25, 2021. CARB alleged Hawthorne violated the Consumer Products Regulation by selling, supplying, offering for sale, or manufacturing for use in California, Alchemist Isopropyl Alcohol Technical Grade 99.9% that is subject to and exceeded a VOC limit of 3 percent by weight for the Multi-purpose Solvent (nonaerosol) category and for failing to display the date of manufacture as outlined in Notice of Violation CP21-06-02. CARB alleges that if the allegations described in Paragraph 6 were proven, civil penalties could be imposed against Hawthorne for each and every day the noncompliant product was sold, supplied, offered for sale or manufactured for use in California.

CARB alleged Hawthorne Advantus violated the Consumer Products Regulation by selling, supplying, offering for sale, or manufacturing for use in California, Alchemist Isopropyl Alcohol Technical Grade 99.9% InkAway Craft Cleaning Wipes, that is subject to and exceeded a VOC limit of 3 1 percent by weight for the MultiHeavy-purpose Solvent (nonaerosol) duty Hand Cleaner or Soap category and for failing failed the annual requirement to display submit an explanation of the code used to indicate the date of manufacture on the product container as outlined in Notice of Violation CP21-0612-02. CARB alleges that if the allegations described in Paragraph 6 were proven, civil penalties could be imposed against Hawthorne Advantus for each and every day the noncompliant product was sold, supplied, offered for sale or manufactured for use in California.California.‌

CARB alleged Hawthorne MMOP violated the Consumer Products Regulation by selling, supplying, offering for sale, or manufacturing for use in California, Alchemist Isopropyl Alcohol Technical Grade 99.9% Mother Earth Distilled White Vinegar that is subject to and exceeded a VOC limit of 3 0.5 percent by weight for the Multi-purpose Solvent General Purpose Cleaner (nonaerosol) category and for failing to display submit an explanation of the manufacturing date of manufacture code with CARB as outlined in Notice of Violation CP21-0603-0205. CARB alleges that if the allegations described in Paragraph 6 were proven, civil penalties could be imposed against Hawthorne MMOP for each and every day the noncompliant product was sold, supplied, offered for sale or manufactured for use in California.
