Common use of Allegations Clause in Contracts

Allegations. This Settlement Agreement settles Notice of Violation (NOV) CP21- 09-02, which was issued on October 25, 2021. CARB alleged PBB violated the Consumer Products Regulation by selling, supplying, offering for sale, or manufacturing for use in California, Green Gobbler 30% Vinegar Home & Garden, that is subject to and exceeded a VOC limit of 0.5 percent by weight for the General Purpose Cleaner (nonaerosol) category and for failing to display the date of manufacture as outlined in NOV CP21-09-02. CARB alleges that if the allegations described in Paragraph 6 were proven, civil penalties could be imposed against PBB for each and every day the noncompliant product was sold, supplied, offered for sale or manufactured for use in California.

Allegations. This Settlement Agreement settles Notice of Violation (NOV) CP21- 09CP23-0207-04, which was issued on October 25August 16, 20212023. CARB alleged PBB Puracy violated the Consumer Products Regulation by selling, supplying, offering for sale, or manufacturing for use in California, Green Gobbler 30% Vinegar Home & Garden, Disinfecting Surface Cleaner that is subject to and exceeded a VOC limit of 0.5 percent by weight for the General Purpose Cleaner (nonaerosol) category category; and for failing Natural Baby Stain Remover, which failed to display the date of manufacture comply with product dating reporting requirements as outlined in NOV CP21#CP23-0907-0204. CARB alleges that if the allegations described in Paragraph 6 were proven, civil penalties could be imposed against PBB Puracy for each and every day the noncompliant product was sold, supplied, offered for sale or manufactured for use in California.

CARB alleged PBB Aiken violated the Consumer Products Regulation by selling, supplying, offering for sale, or manufacturing for use in California, Green Gobbler 30% Vinegar Home & Garden, Mac’s Glass Cleaner that is subject to and exceeded a VOC limit of 0.5 percent by weight for the General Purpose Cleaner (nonaerosol) category and for category; failing to display meet the date of manufacture requirements as outlined in NOV Notice of Violation CP21-0911-0201. CARB alleges that if the allegations described in Paragraph 6 were proven, civil penalties could be imposed against PBB Aiken for each and every day the noncompliant product was sold, supplied, offered for sale or manufactured for use in California.

CARB alleged PBB Smart & Final violated the Consumer Products Regulation by selling, supplying, offering for sale, or manufacturing for use in California, Green Gobbler 30% Vinegar Home & Garden, First Street Glass Cleaner and First Street Stainless Steel Cleaner that is are subject to and exceeded a VOC VOC, limit of 0.5 percent by weight for the General Purpose Cleaner (nonaerosol) Cleaner: nonaerosol category and for with the latter product failing to display the date of manufacture as outlined in NOV CP21Notice of Violation CP20-0910-02. CARB alleges that if the allegations described in Paragraph 6 were proven, civil penalties could be imposed against PBB Smart & Final for each and every day the noncompliant product was sold, supplied, offered for sale or manufactured for use in California.
