Common use of Allegations Clause in Contracts

Allegations. This Settlement Agreement settles Notice of Violation (NOV) CP22- 02-08 which was issued on March 14, 2022. CARB alleged that Pyrolites Firestarters violated the Consumer Products Regulation by selling, supplying, offering for sale, or manufacturing for use in California a noncompliant charcoal lighter material product called Pyrolites Firestarters; failing to display the date of manufacture (Cal. Code Regs., tit.17, § 94512(b)); and failing to meet regulatory standards and certification requirements for charcoal lighter materials (Cal. Code Regs., tit.17, § 94509(h)), as outlined in Notice of Violation CP22-02-08. CARB alleges that if the allegations described in Paragraph 6 were proven, civil penalties could be imposed against Pyrolites Firestarters for each and every day the noncompliant product was sold, supplied, offered for sale or manufactured for use in California.‌
