Agreement with Respect to Loss Sharing Clause Samples

The "Agreement with Respect to Loss Sharing" clause defines how parties to a contract will allocate responsibility for financial losses that may arise under the agreement. Typically, this clause outlines the specific proportions or methods by which losses are divided, such as sharing losses equally, according to ownership percentages, or based on each party's contribution. For example, in a joint venture, the clause might state that each partner bears losses in proportion to their investment. Its core practical function is to provide clarity and prevent disputes by establishing in advance how losses will be handled, thereby allocating risk between the parties.
