Common use of Agreement to Prevail Clause in Contracts

Agreement to Prevail. (a) Notwithstanding the other provisions of this Section 10, in the event of any conflict between the duties and authority of the Joint Coordinating Committee set out in this Section 10 (or any decision of the Joint Coordinating Committee made pursuant thereto) and any other provision of this Agreement, such other provision of this Agreement shall prevail (and the duties and authority of the Joint Coordinating Committee shall be limited accordingly).

Agreement to Prevail. (a) Notwithstanding the other provisions of this Section 109, in the event of any conflict between the duties and authority of the Joint Coordinating Committee set out in this Section 10 9 (or any decision of the Joint Coordinating Committee made pursuant thereto) and any other provision of this Agreement, such other provision of this Agreement shall prevail (and the duties and authority of the Joint Coordinating Committee shall be limited accordingly).
