Common use of Agreement as to Ownership and Use of the Project Clause in Contracts

Agreement as to Ownership and Use of the Project. The Issuer and the Borrower agree that title to the Project shall be in and remain in the Borrower, and that the Project shall be the sole property of the Borrower in which the Issuer shall have no interest. Notwithstanding the provisions of this Section 6.03, the Borrower in its sole discretion and business judgment may choose to cease operation of the Project or transfer the Project to another entity which may cease such operation, and in such circumstances the covenants contained in this Section 6.03 shall no longer apply.
