Common use of ADP Testing Method Clause in Contracts

ADP Testing Method. The ADP Test will be performed using the following testing method: (See Section 6.01(a)(2) of the Plan.) (1) The Plan will use the Current Year Method in running the ADP Test. □ The Current Year Method has applied since the Plan Year. [If the Plan has switched from the Prior Year Method to the Current Year Method, this box may be checked to designate the first Plan Year for which the Current Year Method applies.] □ (2) The Plan will use the Prior Year Method in running the ADP Test. [Note: If the Plan is intended to be a Safe Harbor 401(k) Plan (as designated in AA §6C below), the Plan must use the Current Year Method.]
