Administrative Separations. Effective July 1, 2002, any bargaining unit member who is twenty-five percent (25%) or more over their maximum weight allowance of the program shall be administratively separated from employment with the Department of Public Safety, Division of State Highway Patrol. The bargaining unit member shall retain the right to reinstatement for one (1) year from the date of separation provided that they come into compliance with the Health and Physical Fitness policy. This reinstatement right shall expire at the end of the one (1) year period. The right to reinstatement shall apply once in any five (5) year period. Any bargaining unit member separated under this Article more than one time in any five (5) year period shall have no right to reinstatement.
