Additional Product Terms. Third Party Products, if any, are provided to City subject to any third party terms delivered to City therewith. City shall not, without CFI's prior written consent, copy, provide, disclose or otherwise make available Products or Third Party Products in any form to anyone other than City's employees, consultants or independent contractor, or other named user expressly set forth in the Quote (“Personnel”), who shall use Third Party Products and Products solely for City's internal business purposes in a manner consistent with this Agreement. City shall be fully responsible for the compliance of its Personnel with the terms of this Agreement.

Additional Product Terms. The Cisco SMI Software is required to run the remainder of the CBR-8 Suite. You may use the SMI Software purchased as part of the CBR-8 Suite solely to run the other Software products included in CBR-8 Suite. • For purposes of the Software in the CBR-8 Suite, (i) a Unique User is equivalent to a broadband subscriber and (ii) Bandwidth is equivalent to the number of downstream DOCSIS (Data Over Cable Service Interface Specification) frequency segments (also referred to as "channels") used to transmit downstream broadband data at varying speeds between a device and a Unique User. • If the applicable Entitlement or Documentation identifies a specific DOCSIS version (for example, DOCSIS 3.0 or 3.1), then You can only use Your license with such DOCSIS version(s). • You must register and report license usage for the CBR-8 Suite via Cisco Smart Licensing.   • Additional Products Upon satisfying the minimum order requirements above, Enrolled Affiliate may order Additional Products.

  • Additional Products and Services Subject to the allocation of funds, the CPO may add similar equipment, supplies, services, or locations, within the scope of this Agreement, to the list of equipment, supplies, services, or locations to be performed or provided by giving written notification to Contractor. For purposes of this Section, the “Effective Date” means the date specified in the notification from the CPO. As of the Effective Date, each item added is subject to this Agreement, as if it had originally been a part, but the charge for each item starts to accrue only on the Effective Date. In the event the additional equipment, supplies, services, or locations are not identical to the items(s) already under this Agreement, the charges therefor will then be Contractor’s normal and customary charges or rates for the equipment, supplies, services, or locations classified in the Fees and Costs (Exhibit “F”).

  • License Terms This license is for one full Semester. It cannot be cancelled or terminated except under the conditions cited in this license.

  • Shipment Terms Seller shall ship Goods in the method identified by AGILENT to permit Seller to meet the delivery date(s) identified by AGILENT on the face of this Order (“Delivery Date”). If Seller ships by any other method, Seller shall pay any resulting increase in the cost of freight. Except as specified below, shipments of Goods shall be FCA (as that term is defined in the Incoterms 2010 handbook) Seller's place of shipment/export, and title and risk of loss or damage shall pass from Seller to AGILENT upon Seller's delivery of the Goods to the designated carrier at the place of shipment/export. If AGILENT agrees to pay for applicable freight charges and duties as part of the purchase price, shipment shall be DDP, and title and risk of loss or damage shall pass from Seller to AGILENT upon Seller’s delivery of the Goods to the "Ship To" address identified by AGILENT on the face of this Order.

The City and the Supplier shall have the option to renew this contract for an additional two (2) one-year periods. The contract shall commence upon the issuance of a Notice of Award by the City of Xxxxxx and shall automatically renew each year, from the date of award by City Council, unless either party notifies the other prior to the scheduled renewal date.   • Contract Term Extension “Contract Term Extension” means an extension of the term of this contract, at the request of Purchaser, under this Subsection. This Subsection does not obligate Contracting Officer to grant Contract Term Extension. When such extension is made, Forest Service shall make an appraisal using standard Forest Service methods and appraisal data in effect 45 days prior to the original Termination Date. Bid Premium Rates shall be added to such appraised rates to establish Flat Rates or Tentative Rates for the extension period. In event rates so established would develop Current Contract Value immediately prior to such an extension that is less than Current Contract Value at that time, Flat Rates and Tentative Rates in effect immediately prior to extension shall be retained for the extension period. In consideration for granting an extension, Purchaser shall pay the Government for Purchaser’s failure to cut and remove timber meeting Utilization Standards prior to Contract Term Extension, an amount that shall be the total of the costs to the Government resulting from the delay in harvest of Included Timber. Such costs will be determined by Forest Service and shall include, but not be limited to, the following:
