Common use of Access to Premises and Project Documents Clause in Contracts

Access to Premises and Project Documents. The Contractor must: at the request of the Commonwealth at any time during the Contractor's Activities and the period of 10 years following the latest of the: end of the last Defects Liability Period; date upon which all Defects have been rectified in accordance with the Contract; and completion of the Contractor's Activities, provide and make available: access to its premises and make the Project Documents available for inspection by the Contract Administrator or anyone else acting on behalf of the Commonwealth; such copies of the Project Documents as the Contract Administrator or anyone else acting on behalf of the Commonwealth may require, in such formats as may be required; all such facilities and assistance, answer all questions of, co-operate with and do everything necessary to assist the Contract Administrator or anyone else acting on behalf of the Commonwealth; and any officers, employees, agents or subcontractors for interviews with the Contract Administrator or anyone else acting on behalf of the Commonwealth; as a condition precedent to Completion, deliver to the Contract Administrator a copy of the installed version of each item of software comprising the IT Equipment incorporated in the Works or the Stage, in a storage medium reasonably satisfactory to the Commonwealth, together with a copy of all documentation, including licence terms, warranty terms and operating manuals associated with each item of such software; and ensure that any subcontract made in connection with the Contract contains enforceable obligations requiring the subcontractor to comply with the Contractor's obligations arising under clause 6.12 as if the subcontractor were the Contractor.

The Contractor Subcontractor must: at the request of the Commonwealth Contractor at any time during the ContractorSubcontractor's Activities and the period of 10 years following the latest of the: end of the last Defects Liability Period; date upon which all Defects defects and omissions in the Subcontract Works have been rectified in accordance with the ContractSubcontract; and completion of the ContractorSubcontractor's Activities, provide and make available: access to its premises and make the Project Documents available for inspection and copying by the Contractor’s Representative, the MCC Contract Administrator or anyone else acting on behalf of the Contractor or the Commonwealth; such copies of the Project Documents as the Contractor’s Representative, the MCC Contract Administrator or anyone else acting on behalf of the Contractor or the Commonwealth may require, in such formats as may be required; all such facilities and assistance, answer all questions of, co-operate with and do everything necessary to assist the Contractor’s Representative, the MCC Contract Administrator or anyone else acting on behalf of the Contractor or Commonwealth; and any officers, employees, agents or subcontractors subsubcontractors for interviews with the Contractor’s Representative, the MCC Contract Administrator or anyone else acting on behalf of the Commonwealth; as a condition precedent to Completion, deliver to the Contract Administrator a copy of the installed version of each item of software comprising the IT Equipment incorporated in the Works Contractor or the Stage, in a storage medium reasonably satisfactory to the Commonwealth, together with a copy of all documentation, including licence terms, warranty terms and operating manuals associated with each item of such software; and ensure that any subcontract subsubcontract made in connection with the Contract Subcontract contains enforceable obligations requiring the subcontractor subsubcontractor to comply with the ContractorSubcontractor's obligations arising under clause 6.12 5.7 as if the subcontractor subsubcontractor were the ContractorSubcontractor.

The Contractor Consultant must: at the request of the Commonwealth at any time during the Contractor's Activities Services and the period of 10 years following the latest of the: end of the last Defects Liability Period; date upon which all Defects have been rectified Period (as defined in accordance with the Construction Contract); and completion of the Contractor's ActivitiesServices, provide and make available: access to its premises and make the Project Documents available for inspection by the Contract Administrator or anyone else acting on behalf of the Commonwealth; such copies of the Project Documents as the Contract Administrator or anyone else acting on behalf of the Commonwealth may require, in such formats as may be required; all such facilities and assistance, answer all questions of, co-operate with and do everything necessary to assist the Contract Administrator or anyone else acting on behalf of the Commonwealth; and any officers, employees, agents or subcontractors subconsultants for interviews with the Contract Administrator or anyone else acting on behalf of the Commonwealth; within the time required by the Contract Administrator prior to Completion (as a condition precedent to Completiondefined in the Construction Contract), deliver to the Contract Administrator a copy of the installed version of each item of software comprising the IT Equipment incorporated in the Works or the Stage, Stage (as defined in the Construction Contract) in a storage medium reasonably satisfactory to the Commonwealth, together with a copy of all documentation, including licence terms, warranty terms and operating manuals associated with each item of such software; and ensure that any subcontract made in connection with the Contract contains enforceable obligations requiring the subcontractor subconsultant to comply with the ContractorConsultant's obligations arising under clause 6.12 as if the subcontractor subconsultant were the ContractorConsultant.
