Common use of Access, Etc Clause in Contracts

Access, Etc. Except as shown on the Surveys for the Collateral Pool Properties, the streets abutting such Collateral Pool Property are dedicated and accepted public roads, to which such Collateral Pool Property has direct access by trucks and other motor vehicles and by foot, or are perpetual private ways (with direct access by motor vehicles and by foot to public roads) to which such Collateral Pool Property has direct access approved by the Agent and with respect to which, any applicable Mortgage creates a valid and enforceable first lien or security title. All private ways providing access to such Collateral Pool Property are zoned in a manner which will permit access to the Buildings comprising such Collateral Pool Property over such ways by trucks and other motor vehicles.
