Common use of Acceptable Use Clause in Contracts

Acceptable Use. You agree that you are independently responsible for complying with all applicable laws in all of your activities related to your use of the Service, regardless of the purpose of the use, and for all communications you send through the Service. We and our Service Providers have the right but not the obligation to monitor and remove communications content that we find in our sole discretion to be objectionable in any way. In addition, you are prohibited from using the Service for communications or activities that: (a) violate any law, statute, ordinance or regulation; (b) promote hate, violence, racial intolerance, or the financial exploitation of a crime; (c) defame, abuse, harass or threaten others; (d) include any language or images that are bigoted, hateful, racially offensive, vulgar, obscene, indecent or discourteous; (e) infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the laws of any jurisdiction; (f) impose an unreasonable or disproportionately large load on our infrastructure; (g) facilitate any viruses, trojan horses, worms or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information; (h) constitute use of any robot, spider, other automatic device, or manual process to monitor or copy the Service or the portion of the Site through which the Service is offered without our prior written permission; (i) constitute use of any device, software or routine to bypass technology protecting the Site or Service, or interfere or attempt to interfere, with the Site or the Service; or (j) may cause us or our Service Providers to lose any of the services from our internet service providers, payment processors, or other vendors. We encourage you to provide notice to us by the methods described in Section 6 of the General Terms above of any violations of the General Terms or the Agreement generally.

We encourage you to provide notice to us by the methods described in Section 6 of the General Terms section 7 above of any violations of the General Terms this section or the Agreement generally.

Acceptable Use. You may use the Service to transfer funds as described in section 12 below. You agree that you are independently responsible for complying with all applicable laws in all of your activities related to your use of the Service, regardless of the purpose of the use, and for all communications you send through the Service. We and our Service Providers have the right but not the obligation to monitor and remove communications content that we find in our sole discretion to be objectionable in any way. In addition, you are prohibited from using the Service for communications or activities that: (a) violate any law, statute, ordinance or regulation; (b) promote hatepayments related to illegal gambling, violenceillegal gaming and/or any other illegal activity with an entry fee or a prize, racial intoleranceincluding, but not limited to casino games, sports betting, horse or the financial exploitation greyhound racing, lottery tickets, other ventures that facilitate gambling, games of a crime; skill and sweepstakes (c) defameviolate any property or proprietary right of any third party, abuse, harass or threaten others; (d) include any language or images that are bigoted, hateful, racially offensive, vulgar, obscene, indecent or discourteous; (e) infringe or violate including any copyright, trademark, or right of publicity or privacy or any other proprietary right under the laws of any jurisdiction; (fd) impose an unreasonable or disproportionately large load on our infrastructure; (ge) facilitate any viruses, trojan horses, worms or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information; (hf) constitute use of any robot, spider, other automatic device, or manual process to monitor or copy the Service or the portion of the Site through which the Service is offered without our prior written permission; (ig) constitute use of any device, software or routine to bypass technology protecting the Site or Service, or interfere or attempt to interfere, with the Site or the Service; or (jh) may cause us or our Service Providers to lose any of the services from our internet service providers, payment processors, or other vendors. We encourage you to provide notice to us by the methods described in Section 6 of the General Terms above section 27 below of any violations of the General Terms this section or the this Agreement generally. In no event shall we or our Service Providers be liable for any claims or damages resulting from or related to your violation of the acceptable uses of the Service or this Agreement. We and our Service Providers reserve the right to monitor and remove any comments you post or submit through the Service.

We and our Service Providers have the right but not the obligation to monitor and remove communications content that we find in our sole discretion to be objectionable in any way. In addition, you are prohibited from using the any Service for communications or activities that: (a) violate any law, statute, ordinance or regulation; (b) promote hate, violence, racial intolerance, or the financial exploitation of a crime; (c) defame, abuse, harass or threaten others; (d) include any language or images that are bigoted, hateful, racially offensive, vulgar, obscene, indecent or discourteous; (e) infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the laws of any jurisdiction; (f) impose an unreasonable or disproportionately large load on our infrastructure; (g) facilitate any viruses, trojan horses, worms or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information; (h) constitute use of any robot, spider, other automatic device, or manual process to monitor or copy the Service or the portion of the Site through which the Service is offered without our prior written permission; (i) constitute use of any device, software or routine to bypass technology protecting the Site or Service, or interfere or attempt to interfere, with the Site or the Service; or (j) may cause us or our Service Providers to lose any of the services Service from our internet service providers, payment processors, or other vendors. You agree that you are independently responsible for complying with all applicable laws in all of your activities related to your use of the ServiceZelle and Other Payment Services, regardless of the purpose of the use, and for all communications you send through the ServiceZelle and Other Payment Services. We and our Service Providers have the right but not the obligation to monitor and remove communications content that we find in our sole discretion to be objectionable in any way. In addition, you are prohibited from using the Service Zelle and Other Payment Services for communications or activities that: (a) violate any law, statute, ordinance or regulation; (b) promote hate, violence, racial intolerance, or the financial exploitation of a crime; (c) defame, abuse, harass or threaten others; (d) include any language or images that are bigoted, hateful, racially offensive, vulgar, obscene, indecent or discourteous; (e) infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the laws of any jurisdiction; (f) impose an unreasonable or disproportionately large load on our infrastructure; (g) facilitate any viruses, trojan horses, worms or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information; (h) constitute use of any robot, spider, other automatic device, or manual process to monitor or copy the Service Zelle and Other Payment Services or the portion of the Site through which the Service is Zelle and Other Payment Services are offered without our prior written permission; (i) constitute use of any device, software or routine to bypass technology protecting the Site or ServiceZelle and Other Payment Services, or interfere or attempt to interfere, with the Site or the ServiceZelle and Other Payment Services; or (j) may cause us or our Service Providers to lose any of the services from our internet service providers, payment processors, or other vendors. We encourage you to provide notice to us by the methods described in Section 6 of 11 (Notices to Us Regarding the General Terms Zelle and Other Payment Services) above of any violations of the General Terms or the Agreement generally.

We encourage you to provide notice to us by the methods described in Section 6 of the General Terms above of any violations of the General Terms or the Agreement generally.

We and our Service Providers have the right but not the obligation to monitor and remove communications content that we find in our sole discretion to be objectionable in any way. In addition, you are prohibited from using the Service for communications or activities that: (a) violate any law, statute, ordinance or regulation; (b) promote hatepayments related to illegal gambling, violenceillegal gaming and/or any other illegal activity with an entry or a prize, racial intoleranceincluding, but not limited to casino games, sports betting, horse or greyhound racing, lottery tickets, or the financial exploitation other ventures that facilitate gambling, games of a crimeskill and sweepstakes; (c) defameviolate any property or proprietary right of any third party, abuse, harass or threaten others; (d) include any language or images that are bigoted, hateful, racially offensive, vulgar, obscene, indecent or discourteous; (e) infringe or violate including any copyright, trademark, trademark or right of publicity or privacy or any other proprietary right under the laws of any jurisdiction; (fd) impose an unreasonable or disproportionately large load on our infrastructure; (ge) facilitate any viruses, trojan Trojan horses, worms or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information; (hf) constitute use of any robot, spider, other automatic device, or manual process to monitor or copy the Service or the portion of the Site through which the Service is offered without our prior written permission; (ig) constitute use of any device, software or routine to bypass technology protecting the Site or Service, or interfere or attempt to interfere, with the Site or the Service; or (jh) may cause us or our Service Providers to lose any of the services from our internet service providers, payment processors, processors or other vendors. We encourage you to provide notice to us by the methods described in Section 6 of the General Terms above immediately of any violations of this section or this Agreement. In no event shall we be liable for any claims or damages resulting from or related to your violation of the General Terms acceptable uses of the Service or this Agreement. We reserve the Agreement generallyright to monitor and remove any comments you post or submit through the Service.

We encourage you to provide notice to us by the methods described in Section 6 25 of the General Terms above Online Banking and Bill Payment Agreement of any violations of the General Terms this section or the Agreement Terms of Use generally.

System Xxxx Payment Service You must designate the following: the account from which payments are to be made; the complete name of the payee, the account number, and the payee's remittance address, all exactly as shown on the billing statement or invoice; the amount of the payment and the date you want the payment to be debited from your account. By using the Online Banking Xxxx Payment Service option, you agree that, based upon instructions received under your password, we will debit your designated account by electronic transfer, or by debiting and remitting funds on your behalf. We reserve the right to refuse payment to any payee designated by you. If we do so, we will notify you. Scheduling System Payments If the payee is to be paid by paper check, you understand and agree that paper checks are mailed to the payee and the payee may not receive the payment until 4 business days after the date the payment is scheduled. You understand and agree that we are not responsible for the timely delivery of mail or the improper transmission or handling of payments by a third party, such as the failure of the Xxxx Payment payee to properly post a payment to your account. You understand and agree that a future dated payment is a one-time payment scheduled to be paid on the date you designated in the Xxxx Payment setup. You also understand and agree that recurring payments are payments scheduled to be paid on a regular basis automatically on a pre- determined schedule for the same amount as you designated in the Xxxx Payment setup, without any further action by you. Cancel a Xxxx Payment To cancel a Xxxx Payment scheduled through Online Banking, you must cancel the payment online via Online Banking (by following the onscreen instructions) before 6:30 p.m. C.S.T on the date the payment was submitted. Zelle® Personal Payments Service Zelle® allows payments to be sent directly by you to other trusted individuals via email, text message or checking/savings account information. The bank reserves the right to limit the frequency and dollar amount of transactions from your Online Accounts for security reasons. Risk limits for transactions using Zelle are based on the funding account and may be different for each funding account. The minimum payment amount is $5.00. The maximum amount available for transfer can be viewed by clicking the Limits icon on the Enter Amount screen. By using Zelle, you agree that, based upon instructions received under your password, we will debit your designated account by electronic transfer, or by debiting and remitting funds on your behalf. Mobile Banking FFB MobiBank is offered as a convenience and supplemental service to First Federal Bank’s Internet Banking services. It is not intended to replace access to Internet Banking from your personal computer or other methods you use for managing your accounts and services with us. To utilize the FFB MobiBank service, you must first enroll for and maintain enrollment in, Internet Banking. Once you have signed in to First Federal Bank’s Internet service, you may access your accounts with supported Wireless Devices by following our instructions for enrolling and activating your Wireless Device. You will be required to accept a separate Mobile Banking Terms & Conditions in order to utilize the service. These terms, provisions, or conditions constitute a part of the Mobile Banking service terms and the Agreement. When you activate your Wireless Device, and each time you use or allow anyone else to use the Mobile Banking Service, you confirm your agreement to abide by and to be bound by the terms and conditions of the Mobile Banking Service in effect at that time and the and Mobile Remote Deposit Terms & Conditions. With FFB MobiBank, you may check account balances and transactions, transfer funds between your linked accounts, pay bills and people, and submit mobile check deposits. To enroll in Mobile Banking, you must first login to First Federal Bank’s Internet Banking site. Once logged in, select the "Options" tab of the site. Under the Mobile Device Section, click "Enroll" to begin the process. Alternatively, from your Wireless Device, you may download the FFB MobiBank Application to begin the enrollment process. Alerts Your enrollment in First Federal Bank of Louisiana Online Banking and/or Mobile Banking (the “Service”) includes enrollment to receive transaction alerts and notifications (“Alerts”). Alerts are electronic notices from us that contain transactional information about your First Federal Bank of Louisiana account(s). Alerts are provided within the following categories: • Mandatory Alerts provide you with important account notifications, such as information about changes to your Online Banking password, PIN, or login information. You do not have the option to suppress these Mandatory Alerts. • Account Alerts provide you with notification of important account activities or when certain changes are made to your Service accounts, such as scheduled payments made, scheduled payments cancelled and mobile deposits. These Alerts are automatically activated for you. Although you may suppress these Account Alerts, we strongly recommend that you do not do so because they provide important information related to your Service account. • Additional Alerts must be activated by you to be enabled. These Additional Alerts can be accessed from the Alerts menu within First Federal Bank of Louisiana Online Banking and Alerts menu within First Federal Bank of Louisiana Mobile Banking. Account Alerts and Additional Alerts must be managed and/or added online through the Service. You cannot maintain all Alerts though your mobile device. We may add new Alerts from time to time, or cancel old Alerts. We usually notify you when we cancel Alerts, but are not obligated to do so. First Federal Bank of Louisiana reserves the right to terminate its Alerts service at any time without prior notice to you. Methods of Delivery. We may provide Alerts through one or more channels (“EndPoints”): (a) a mobile device, by text message, (b) a mobile device, by push notification; (c) an email account, by an e-mail message; or (d) your First Federal Bank of Louisiana Online Banking message in- box, by an e-mail message. You agree to receive Alerts through these EndPoints, and it is your responsibility to determine that each of the service providers for the EndPoints described in (a) through (c) above supports the email, push notification, and text message Alerts provided through the Alerts service. Please be advised that text or data charges or rates may be imposed by your EndPoint service provider. Alert frequency varies by account and preferences. You agree to provide us a valid mobile phone number or email address so that we may send you Alerts. If your email address or your mobile device's number changes, you are responsible for informing us of that change. Your Alerts will be updated to reflect the changes that you communicate to us with regard to your primary and secondary email addresses or mobile device number. Alerts via Text Message. To stop Alerts via text message, text "STOP" to 995-88 at any time. Alerts sent to your primary email address will be unaffected by this action. To restore Alerts on your mobile phone, just visit the Alerts tab in First Federal Bank of Louisiana Online Banking and click the box next to your mobile number for the Alerts you'd like to receive again. In addition, you are prohibited from using the Service for communications or activities that: (a) violate any law, statute, ordinance or regulation; (b) promote hate, violence, racial intolerance, or the financial exploitation of a crime; (c) defame, abuse, harass or threaten others; (d) include any language or images that are bigoted, hateful, racially offensive, vulgar, obscene, indecent or discourteous; (e) infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the laws of any jurisdiction; (f) impose an unreasonable or disproportionately large load on our infrastructure; (g) facilitate any viruses, trojan horses, worms or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information; (h) constitute use of any robot, spider, other automatic device, or manual process to monitor or copy the Service or the portion of the Site through which the Service is offered without our prior written permission; (i) constitute use of any device, software or routine to bypass technology protecting the Site or Service, or interfere or attempt to interfere, with the Site or the Service; or (j) may cause us or our Service Providers to lose any of the services from our internet service providers, payment processors, or other vendors. We encourage you to provide notice to us by the methods described in Section 6 of the General Terms above IX.H., “Notices,” below of any violations of the General Terms or the Agreement generallythis Agreement.
