Common use of ABATEMENT OF RENT; LESSEE'S REMEDIES Clause in Contracts

ABATEMENT OF RENT; LESSEE'S REMEDIES. (a) In the event of (i) Premises Partial Damage or (ii) Hazardous Substance Condition for which Lessee is not legally responsible, the Base Rent, Common Area Operating Expenses and other charges, if any, payable by Lessee hereunder for the period during which such damage or condition, its repair, remediation or restoration continues, shall be abated in proportion to the degree to which Lessee's use of the Premises is impaired. Except for abatement of Base Rent, Common Area Operating Expenses and other charges, if any, as aforesaid, all other obligations of Lessee hereunder shall be performed by Lessee, and Lessee shall have no claim against Lessor for any damage suffered by reason of any such damage, destruction, repair, remediation or restoration.

Except for abatement of Base Rent, Common Area Operating Operation Expenses and other charges, if any, as aforesaid, all other obligations of Lessee hereunder shall be performed by Lessee, and Lessee shall have no claim against Lessor for any damage suffered by reason of any such damage, destruction, repair, remediation or restoration.

(a) In the event of (i) Premises Partial Damage damage to the Premises, whether or (ii) Hazardous Substance Condition for which not Lessor or Lessee is not legally responsiblerepairs or restores the Premises, the Base Rent, Common Area Operating Expenses Real Property Taxes, insurance premiums, and other charges, if any, payable by Lessee hereunder for the period during which such damage or conditiondamage, its repair, remediation repair or the restoration continues, shall be abated in proportion to the degree to which Lessee's use of the Premises is impaired. Except for abatement of Base Rent, Common Area Operating Expenses Real Property Taxes, insurance premiums, and other charges, if any, as aforesaid, all other obligations of Lessee hereunder shall be performed by Lessee, and Lessee shall have no claim against Lessor for any damage suffered by reason of any such damage, destruction, repair, remediation repair or restoration.

ABATEMENT OF RENT; LESSEE'S REMEDIES. (a) Abatement. In the event of (i) Premises Partial Damage or (ii) Premises Total Destruction .or a Hazardous Substance Condition for which Lessee is not legally responsibleresponsible under this Lease, the Base Rent, Common Area Operating Expenses and other charges, if any, Rent payable by Lessee hereunder for the period during which such damage or condition, its required for the repair, remediation or restoration continues, of such damage shall be abated in In proportion to the the. degree to which Lessee's ’s use of the Premises is reasonably and materially impaired, but not to exceed the time period for which Lessor is Squired to carry Rental Value insurance under this Lease. Except for abatement of Base Rent, Common Area Operating Expenses and other charges, if any, as aforesaid, all All other obligations of Lessee hereunder shall be performed by Lessee, and Lessee Lessor shall have no claim against Lessor liability for any damage suffered by reason of any such damage, destruction, repairremediation, remediation repair or restoration.restoration except as provided herein:
