C. Timeframe of Decisions A decision whether to retain, reduce in grade, or remove an employee shall be made not later than thirty (30) days after the date of expiration of the notice period. The employee will be given this decision in writing. Unless the action is proposed by the Head of the Agency, the deciding official will be at a higher management level than the proposing official. The decision will:
1. Specify the instances of unacceptable performance and the critical element(s) for which the employee did not achieve successful performance.
2. Specify the action to be taken, the effective date, and the employee's right to appeal the decision.
