Breach. In the event the responsible Consortium Body identifies a non-performance or default, including delay, in performance by a Party of its obligations under this Consortium Agreement or the Grant Agreement, the Coordinator will give written notice requiring that such breach be remedied within [30-45-60] calendar days. If the breach is not due to Force Majeure and if it is not capable of remedy or not remedied within that period, the General Assembly may decide to declare the Party to be a Defaulting Party and to decide on the consequences thereof which may include termination of its participation. The Parties agree that if a Party wishes to terminate its participation in the Project, it will be considered as a request for termination as provided for in article II.36.6 of the Grant Agreement and the provisions of this Consortium Agreement regarding such termination shall apply.
Breach. If a Party is in breach of its obligations under the Agreement, and the breach is not cured within 30 days after written notice of the breach is delivered to the breaching Party, then any other Party may elect to terminate the Agreement.
Breach. In addition to any contractual rights and remedies under the applicable law, uPblisher shall retain the right to deny access to any publisher-hosted content where the Institution is in breach of any of the conditions of this APEPNDIX NO. 7. In cases where Institution has made any uSbscribed products available to third parties, uPblisher shall be entitled to terminate the Contract, including this AEPNDIX NO. 7, with respect to the Institution and shall have the right to claim damages, and disgorging of any profits generated by activities prohibited under this AEPNDIX NO. 7
Breach. In addition to any contractual rights and remedies under the applicable law, Publisher shall retain the right to deny access to any publisher-hosted content where the Institution is in breach of any of the conditions of this APPENDIX NO. 7. In cases where Institution has made any Subscribed products available to third parties, Publisher shall be entitled to terminate the Contract, including this APPENDIX NO. 7, with respect to the Institution and shall have the right to claim damages, and disgorging of any profits generated by activities prohibited under this APPENDIX NO. 7
Breach. 9.1 In the event of the Lessee failing to meet his/her/its obligations under this agreement, the Lessor shall be entitled to cancel this agreement or demand specific performance of the Lessee’s obligations together with any damages suffered by the Lessor as a result of such default, provided that the Lessee is given 7 (seven) days’ written notice to remedy the default.
9.2 The Lessee agrees to accept service of any legal process at the physical address recorded on the information page under “Lessee Details”, “Alternate Contact Details” or “Next of Kin” but agrees to accept delivery of other notices at any of the Lessee’s email addresses or fax numbers recorded on the information page.
