Window Program definition

Window Program means a program the Employer establishes in connection with an impending Separation from Service to provide Separation Pay to separated Participants and which program is available only for a period of up to 12 months for Participants who separate during such period or who separate during such period under specified circumstances. A Window Program does not include a program the Employer establishes under which there is a pattern of repeated provision of similar Separation Pay in similar situations for substantially consecutive limited periods of time. Whether a recurrent program constitutes such a pattern depends upon all of the facts and circumstances, including whether the benefits are account of a specific event or condition, the degree to which the separation pay relates to the event or condition and whether the event or condition is temporary or discrete or is a permanent aspect of the Employer’s business.
Window Program means a program the Employer establishes to provide, for a limited period of time not exceeding one year, Separation Pay in connection with Separation from Service, or in connection with Separation from Service under prescribed circumstances, and otherwise as described in Prop. Treas. Reg. §1.409A-1(b)(9)(v) or in Applicable Guidance.

Examples of Window Program in a sentence

  • Employees who retire under this Window Program in the year 2005 will receive the benefits provided under the plan as of March 2005, and will include any negotiated benefit increases that take effect in March 2005.

  • Employees who retire under this Window Program in the year 2006 will receive the benefits provided under the plan as of March 2006, and will include any negotiated benefit increases that take effect in March 2006.

  • Newco-UAW Represented Employees who were eligible for and elected to participate in the Window Program shall receive, in addition to any other benefit offered under the Window Program, if any, Retiree Medical Benefits at levels that are equivalent to those provided to Class Members and Covered Group members who are receiving Retiree Medical Benefits outside of the Window Program.

  • CGs must be prepared to financially support the added accompanied dependants, and any non-accompanied dependants who are following the sponsored family later under the One Year Window Program.

  • To be eligible to participate in the Window Program a Newco-UAW Represented Employee must have: (i) been a member of the Covered Group, (ii) been retirement eligible under the Amended Plan, (iii) voluntarily terminated his or her employment with Chrysler during the Window, and (iv) met such other reasonable administrative terms and conditions as were adopted under the Window Program.

  • If the Separation Pay results from a Window Program, the Participant may make the election at any time up to the time that the Participant’s election to participate in the Window Program becomes irrevocable.

  • Window Program participants' Retiree Medical Benefits shall be provided by Newco until the expiration of the 24-month period that began upon the Newco- UAW Represented Employee's participation in the Window Program, as determined pursuant to administrative procedures adopted thereunder.

  • Retirement program means a program of rights and obligations which a county, city, village, or township establishes, maintains, or participates in and which, by its express terms or as a result of surrounding circumstances, does 1 or more of the following:

  • AML Program has the meaning ascribed thereto in Schedule 2.1(F)(8) hereof.

  • PEBB program means the program within the HCA that administers insurance and other benefits for eligible employees (as described in WAC 182-12-114), eligible retired employees (as described in WAC 182-12-171 and 182-12-180), eligible survivors (as described in WAC 182-12-180, 182-12-250, and 182-12-265), eligible dependents (as de- scribed in WAC 182-12-250 and 182-12-260) and others as defined in RCW 41.05.011.

  • School-Sponsored Activity means any activity conducted on or off school property (including school buses and other school-related vehicles) that is sponsored, recognized or authorized by the Board of Education.

  • Post-Termination Exercise Period means the period following termination of a Participant’s Continuous Service within which an Option or SAR is exercisable, as specified in Section 4(h).
