WHX Group definition

WHX Group means WHX, each Subsidiary of WHX and each Affiliate of WHX (other than the Borrower and its Subsidiaries and joint ventures) (provided, that when used in this definition, clause (b) of the definition of "Affiliate" shall be deemed to be modified to substitute "WHX or any Subsidiary of WHX" for the words "the Borrower or any Restricted Subsidiary(ies))".

Examples of WHX Group in a sentence

  • Any financial statements distributed to any creditors of the Borrower and its Subsidiaries shall, to the extent permitted by GAAP, clearly establish the corporate separateness of such Person from each member of the WHX Group and each other Affiliate.

  • Neither the Borrower nor any of its Subsidiaries shall make any payment to a creditor of any member of the WHX Group in respect of any liability of such Person (other than pursuant to a liability or transaction otherwise permitted hereunder), and no bank account of the Borrower or any of its Subsidiaries shall be commingled with any bank account of any other Person.

  • On the Effective Date, WPSC shall be deemed to have transferred any and all of its claims against any member of the WHX Group of the type that is the subject of the release attached hereto as Exhibit C to WPC.

  • ▇▇▇▇ Group means collectively ▇▇▇▇ Capital Fund V, L.P., ▇▇▇▇ Capital Fund V-B, L.P., BCIP Associates, BCIP Trust Associates, L.P. and ▇▇▇▇▇▇▇▇ Street Partners.

  • ▇▇▇▇▇ Group means ▇▇▇▇▇ and any Affiliate of ▇▇▇▇▇.

  • ▇▇▇▇▇▇ Group shall have the meaning set forth in Section 9.2(b) hereof.

  • Tax Group means any federal, state, local or foreign consolidated, affiliated, combined, unitary or other similar group of which the Acquiror Company is now or was formerly a member.
