Wheelage definition

Wheelage means the charges for transmission of water through a Member’s distribution system to be delivered to another Member, calculated and administered in accordance with Section 5.5.

  • Assessment of interest by COLT shall in no way be deemed or construed, by Lessee or others, to be a waiver of Lessee’s obligation to promptly pay all royalties (Actual Production, Minimum, Wheelage or otherwise) and other sums due COLT, when due and without demand, or to be a waiver or bar to the subsequent exercise or enforcement by COLT of any other provisions of this Lease or any other right of COLT hereunder.

  • Notwithstanding anything herein to the contrary, Sublessee shall comply with all obligations of Grantee pursuant to that certain Coal Haul Road Right-of-Way, dated August 8, 2014, between Consol Amonate Facility LLC, as Grantor, and Berwind Land Company, as Grantee (the “Consol ROW”), including, but not limited to, the obligation to pay Annual Fees and Wheelage Charges, as defined therein, under Section 4 of the Consol ROW.

  • Assessment of interest by RGGS shall in no way be deemed or construed, by Lessee or others, to be a waiver of Lessee’s obligation to promptly pay all royalties (Actual Production, Minimum, Wheelage or otherwise) and other sums due RGGS, when due and without demand, or to be a waiver or bar to the subsequent exercise or enforcement by RGGS of any other provisions of this Lease or any other right of RGGS hereunder.

  • Such payment shall be in addition to any other type of Wheelage Payment to be made with regard to any other Prime Lease.

  • If a Wheelage Fee is not required under the Prime Leases, then no Wheelage Fee shall be due under this Sublease.

  • Wheelage of "Foreign Coal"; LESSEE shall pay to LESSOR the sum of Fifteen Cents ($00.15) per net ton of two thousand (2,000) pounds for each ton of foreign clean coal with LESSEE shall bring upon the herein leased surface, for the purpose of "reshipping".

  • Sublessee shall reimburse to Sublessor for the said right to transport coal across any Subleased Premises where the Prime Lease requires any type of such Wheelage Payment to be made.

  • Wheelage Fees provided for in this section shall not be recouped by Lessee.

  • COLT further grants unto Lessee, subject to the Wheelage provisions of section 13 below, the right to make and use underground passages or entries through the Premises to and from other mines and lands adjacent thereto and the removal of coal and other property therefrom and with the right to the use of said passages and entries until the termination of this Lease as reasonably necessary by Lessee.
