Usage and Performance Data definition

Usage and Performance Data means any data derived from Customer Materials, End User Materials and/or the use of the Platform or Services by Customer and its End Users. Such data includes, but is not limited to, performance and statistical information about the actual transactions facilitated by and/or between Customer and its End Users through the Platform, which is collected, generated and tracked by Art Blocks. For the avoidance of doubt, Usage and Performance Data does not include any Customer Materials or End User Materials from which it is derived.
Usage and Performance Data means “Usage and Performance Data” means any data derived from Customer’s or any End User’s use of the STS Technology, including without limitation performance and statistical information about the actual transactions facilitated by and/or between Customer and End Users through the Platform, which is collected, generated and tracked by STS.

  • Customer agrees that Kong (and its Affiliates, contractors, successors, and assigns) can collect, maintain, process, use and otherwise fully exploit the Usage and Performance Data in any way now or in the future for its legitimate business purposes, including to corrects errors in Software, to maintain and improve its products and services, to deliver support services, and to monitor license compliance.

  • As part of the Platform Services, Intuit collects and tracks Usage and Performance Data to assist with the necessary operation and function of the Platform; to provide reporting to Customer; and for internal purposes, including without limitation, to facilitate in the provision of updates and support, by Intuit, its Affiliates, and its agents, and for research and development.

  • Intuit will only disclose Usage and Performance Data to Third Parties, including its subcontractors, for the purposes of facilitating the Services as described in this Agreement, to perform its other obligations, and exercise its rights under this Agreement, or as otherwise required by law.

Related to Usage and Performance Data

  • Energy Performance Score means the numeric rating generated by Portfolio Manager that compares the Energy usage of the building to that of similar buildings.

  • Index Performance means, in relation to an Index and an Auto-Call Valuation Date or the Valuation Date, as the case may be, a percentage calculated by the Calculation Agent in respect of such date in accordance with the following formula:

  • Basket Performance means a decimal number calculated by applying the following formula:

  • energy performance contracting means a contractual arrangement between the beneficiary and the provider of an energy efficiency improvement measure, verified and monitored during the whole term of the contract, where investments (work, supply or service) in that measure are paid for in relation to a contractually agreed level of energy efficiency improvement or other agreed energy performance criterion, such as financial savings;

  • Final Performance means the Final Valuation Price divided by the Initial Price(Settlement) each in respect of the Worst Performing Underlying Asset as calculated in respect of the Final Valuation Date. "Final Valuation Date" means 29 November 2027, subject to adjustment.
