ChipMOS has not undertaken any procedure to apply for the delisting of its shares from the TWSE.
Without obtaining the Foreign Investor Investment I.D. and opening such Accounts, the withdrawing Holder would be unable to hold or subsequently sell the Deposited Securities withdrawn from the ADR Facility on the TWSE or otherwise.

The Company agrees to deliver to the Depositary and/or the Custodian, as applicable, written confirmation of the number of Listed Shares deposited with the Custodian under this Deposit Agreement promptly upon the receipt of confirmation of listing from the TWSE of such Shares.
SPIL has not taken any steps to apply for delisting from the TWSE.
For the avoidance of doubt, in the case in any trading of shares of OSE, NYSE, Shanghai-Hong Kong Stocks Connect, SGX, TSE, TSX, TWSE and B shares in The People’s Republic of China, the Company will be maintaining an omnibus account with the Correspondent Agents.
If the Closing Date falls after the book closure date filed with the TWSE for the 2016 SPIL ordinary shareholders’ meeting, SPIL shall promptly convene an extraordinary shareholders’ meeting within three months of the Closing Date and cause one person designated by the Subscriber to be nominated as a candidate for director.
