  • The actual out-of-pocket cost of incorporating Holdco will be borne by TCAM and Fronteer prorata their interests.

  • If TCAM has not prepared a Feasibility Study as part of its earn-back or if no Feasibility Study has been previously approved, Holdco may, if its Board approves, prepare a Feasibility Study as a separate Program.

  • Except as otherwise provided above, the Property is being optioned on an as-is, where-is basis and Fronteer acknowledges that TCAM makes no representation or warranty of the condition of the Property.
