System Area definition

System Area means all the geographic area within the boundaries of theInclusive Area Party Agencies” and those designated areas for inclusion within the System which are also within the boundaries of the “Non-Inclusive Area Party Agencies.” 1.13.1 The “System Area” may be modified, upon consent of all Parties, to include area within an adjoining county; 1.13.2 The “System Area” may be modified, upon consent of all Parties, to exclude area within Ada County upon the condition the area excluded will then be subject to a like “System” in an adjoining County.
System Area means a major trading area to which the Owner or any Owner Affiliate has an FCC License to operate PCS services.

  • In any given PCS System and/or System Area the RF Engineering Services price will be readjusted (and any amounts owed to either Party will be reimbursed) at the point in time that payment would be made for such RF Engineering pursuant to clause (iii) of this subsection 6.4(b) in accordance with the determination of the actual Final Site Count and delivery of Final RF Design applicable to such PCS System.

  • In any given System Area or System Sub-Area, completion of Network Interconnection in such System Area or System Sub-Area at least sixty (60) days (or as otherwise mutually agreed between the Parties at such time) prior to Milestone 7 (as set forth on Exhibit A1) will be a prerequisite to the Vendor's obligation pursuant to the terms of this Contract to successfully achieve Milestone 7 (as set forth in Exhibit A1) in such System Area or System Sub-Area.

  • The Parties shall respond to 9-1-1 and other calls necessitating the services of the System within the System Area.

  • To the extent the Vendor is in control of any System Element Location, or other site within the System or any System Area during the term of this Contract (a "Vendor-Controlled Location") including, but not limited to, during the build-out of the Initial System, the Vendor will be solely responsible for initiating, maintaining, and supervising all safety precautions and programs in connection with all such Vendor-Controlled Locations.

  • In the event a terminated Party fails to cease to provide EMS services in the System Area, the remaining Parties may seek specific performance of this provision of the Agreement and may also seek temporary and permanent injunctive relief in an action for specific performance filed in a court of competent jurisdiction.

  • Each Party agrees, as a special consideration to each other Party, that in the event they withdraw from this Agreement, either by voluntarily withdrawing or for cause by default, that they will cease to provide EMS services in the System Area for the remainder of the Agreement term and shall either forfeit or modify their EMS license to the Department of Health and Welfare Bureau of EMS as that license authorizes EMS services in the System Area by that Party.

  • If EMS standards, protocols and procedures adopted by the Board impose higher standards than are required by any state statute or rule the standards and procedures adopted by the Board shall apply to the Parties to the extent allowed by law in the System Area.

  • Each Party agrees, as a special consideration to each other Party, that in the event they are terminated from this Agreement, either by voluntarily withdrawing or for cause by default, that they will cease to provide EMS services in the System Area for the remainder of the Agreement term and shall either forfeit or modify their EMS license to the Idaho Department of Health and Welfare EMS Bureau as that license authorizes the provision of EMS services in the System Area by that Party.

  • In the event a withdrawing Party fails to cease to provide EMS services in the System Area, the remaining Parties may seek specific performance of this provision of the Agreement and may also seek temporary and permanent injunctive relief in an action for specific performance filed in a court of competent jurisdiction.

  • Unless otherwise waived by the Owner, however, completion of Microwave Relocation in any given System Area or System Sub-Area will be a prerequisite to the commencement of the Substantial Completion testing to be performed by the Vendor in accordance with Exhibit B3 in such System Area or System Sub-Area.


More Definitions of System Area

System Area. The geographical area as described in Exhibit A hereto.
System Area means a geographic area in the Territory to which Sprint ----------- Spectrum or any Affiliate has the right to operate or is operating PCS services.
System Area means each of the geographic areas in which the Customer is operating, managing, constructing, planning to operate, manage or construct or otherwise possessing rights to operate, manage or construct a PCS system or any PCS Services.
System Area means each of the ACAA Area, the ▇▇▇▇▇▇▇▇ Area, the Majorsville Area, the Mamont Area, the ▇▇▇▇▇▇ Area, the ▇▇▇▇▇▇▇ ▇▇▇▇▇ Area and the Wadestown Area. In the determination of each System Area at any given point in time, if Gatherer (i) has received a Tie-In Request under which Gatherer is obligated to extend the applicable Individual System to a Receipt Point for an Existing Well or Planned Well or is subject to a Deemed Tie-In Request under which Gatherer is obligated to extend the applicable Individual System to a Receipt Point for a Planned Well in the next 24 Months, (ii) is otherwise obligated under this Agreement at that time to extend the applicable Individual System to a Receipt Point for an Existing Well or Planned Well or (iii) has agreed in writing to extend the applicable Individual System to a Receipt Point for an Existing Well or Planned Well, then such System Area shall also include a three mile radius of such Existing Well or Planned Well, but in no event shall any System Area ever extend beyond the Dedication Area.
