Supplemental Settlement Payment definition

Supplemental Settlement Payment means an amount up to Seventy-Five Thousand Dollars ($75,000.00) that Venus will pay into the Settlement Fund if the number of timely, valid, and approved claims before any pro rata or decrease is made exceeds the Settlement Fund after all claims, class notice and administration costs, and Attorneys’ Fees and Expenses are paid. Venus shall only be required to pay into the Settlement Fund as much as is necessary to compensate Settlement Class Members for their Initial Claim Amounts. Under no circumstance shall Venus be required to pay any more than Nine Hundred Twenty-Five Thousand Dollars ($925,000.00) into the Settlement Fund.
