The Contract Price, Compensable Curtailment Price and Storage Price will not be adjusted on the basis of any action of any Governmental Authority with respect to changes to or revocations of sales and use tax benefits, rebates, exceptions or give backs.

In relation to the Storage Price stipulated in point 2.1 of this Agreement, the method of invoicing and the deadline for issuing and delivering an invoice shall be as specified in point 10.12(a) of the General Terms and Conditions setting out commercial terms and conditions for access to and use of the Storage Facility attached as Annex No. 3 to this Agreement (hereinafter referred to as the “General Terms and Conditions”).
For and in consideration of PacifiCorp’s payment of the Storage Price to Seller pursuant to Section 5.1, PacifiCorp shall have all right, title, and interest in and to all Capacity Rights and Ancillary Services associated with the Storage Facility existing during the Term.
