Severe Hardship definition

Severe Hardship for the purposes of this clause shall mean where the radial distance to the new work site, measured from the employees home, is at least an additional 10 kilometres over the distance from the employee’s home to the existing plant site. An employee offered continued employment at another Inghams location will be allowed a trial period of 4 weeks working at the new location before a final decision needs to be made to accept such employment. An employee who accepts permanent employment with ▇▇▇▇▇▇▇ at an alternate location will receive a relocation payment of $500.00. For each week of employment at the alternate location, for a maximum of 52 weeks, an employee shall be entitled to a travel payment as follows:
Severe Hardship of a Participant for purposes of this paragraph shall be determined by the Administrator upon review of each situation and in accordance with the following objective standard and means an immediate and heavy need for financial assistance in meeting obligations incurred or to be incurred by the Participant, taking into account the Participant's other reasonably available resources, as provided below. A Severe Hardship shall be considered to exist only where the conditions of both of the following clauses (i) and (ii) are satisfied: (i) The immediate and heavy need requirement shall be considered satisfied only where the need is on account of any of the following: (A) Medical expenses (to the extent not reimbursable or compensable by any plan, program, insurance or otherwise) described in Section 213(d) of the Code of the Participant, the Participant's spouse or any of the Participant's dependents (as defined in Section 152 of the Code). (B) Acquisition (excluding mortgage payments) of a dwelling unit which within a reasonable time is to be used (determined at the time the withdrawal is made) as the principal residence of the Participant. (C) Payment of tuition and related educational fees for the next twelve (12) months of post-secondary education for the Participant, the Participant's spouse, the Participant's children or any of the Participant's dependents (as defined in Section 152 of the Code).

Examples of Severe Hardship in a sentence

  • Severe Hardship withdrawals are permitted under paragraph 9.6 of the Plan by Participants from the [Check one(s) desired]: [x] (A) Pre-tax Unmatched Account.

  • The amount of the immediate and heavy financial need may include any amounts necessary to pay any federal, state or local income taxes or penalties reasonably anticipated to result from the Severe Hardship distribution.

  • Unless the Administrator provides for a different ordering, Severe Hardship withdrawals shall be made first from the Participant's After-Tax Basic Account, then from his Pre-Tax Account, then from his Unrestricted Matching Account, and lastly from his Unrestricted Profit Sharing Account.

  • In the event of Employee's (i) death, (ii) termination on account of Disability, (iii) termination on account of Severe Hardship, (iv) termination for Good Reason or (v) termination initiated by the Company for any reason other than Cause, the then outstanding balance in the Record Account of the Employee, including interest credited to the Termination Date, will be paid to Employee (or his designated beneficiary) as described in Section 8(e) below.

  • Amounts credited to Employee's Record Account pursuant to the Special Sign-On Bonus in Section 4 above, including interest credited thereon, shall be forfeited in the event of (i) any termination of employment initiated by Employee other than for Good Reason, death, Disability or on account of Severe Hardship during the first three years immediately following the Merger Date or (ii) Employee's termination of employment for Cause.

  • For purposes of this Agreement, events and situations constituting "Severe Hardship" shall be determined in the judgment of the Compensation Committee of the Company's Board of Directors.

Related to Severe Hardship

  • Undue hardship means an action requiring significant difficulty or expense, when considered in light of the following factors:

  • Hardship means deprivation, suffering, adversity, or long-term adverse financial impact in complying with the title plant requirement that is more than minimal when considering all the circumstances. Financial hardship alone may constitute a hardship.

  • Financial Hardship means a situation where:

  • Unforeseeable Emergency means a severe financial hardship of the Participant resulting from an illness or accident of the Participant, the Participant’s spouse, the Participant’s Beneficiary, or the Participant’s dependent (as defined in Code Section 152, without regard to Code section 152(b)(1), (b)(2) and (d)(1)(B); loss of the Participant’s property due to casualty; or other similar extraordinary and unforeseeable circumstances arising as a result of events beyond the control of the Participant.

  • Severe or "extraordinary" condition is defined as serious or extreme and/or life threatening.
