Sampling Person definition

Sampling Person means the person or entity specified in the relevant Confirmation that will pay for and perform, or cause to be performed, sampling and analysis of the Fuel pursuant to a Transaction. Unless otherwise agreed by the Parties in a Confirmation, the Sampling Person shall be Seller for sampling purposes and the Sampling Person shall be deemed to be Buyer for analysis purposes.
Sampling Person has the meaning set forth in Section 5.3.1.
Sampling Person means the Party obligated for performing, or causing to be performed, sampling of Coal and paying the costs therefor.

  • The Sampling Person shall cause a representative Coal sample to be taken by mechanical sampler that is in working condition and that has been dynamically bias tested within twelve (12) months prior to delivery by an independent certified third party.
