  • If requested by the County Engineer and not previously provided under this Road Use and Repair Agreement, the Developer shall provide plans and specifications to the County Engineer for the road repair or reconstruction consistent with the restoration criteria and the Initial Evaluation (the “Plans and Specifications”).

  • If any provisions of this Road Use and Repair Agreement are determined to be unenforceable, invalid or excessive, this Road Use and Repair Agreement can thereafter be modified in accordance with Article 5.2 of this Road Use and Repair Agreement, to implement the intent of the Developer and the County to the maximum extent allowable under law and the remainder of this Road Use and Repair Agreement shall remain unaffected and in full force and effect.
