Pursuant to TSCA Section 6(e) and 40 CFR § 761.77(c), the EPA is authorized to issue TSCA PCB Coordinated Approvals based on existing state permits or enforcement and decision documents which exercise control over PCB wastes.
To the knowledge of the Company, no underground storage tanks, asbestos, asbestos-containing materials, polychlorinated biphenyls (PCBs) or PCB wastes were previously located, contained, used or stored at or on any of the Company’s or any of its Subsidiaries’ properties that, individually or in the aggregate, are material.
