HACLA shall provide all available information relating to the Park Site, as expeditiously as necessary, for the orderly progress of the Scope of Work.
There shall be no access fee connected with Parks’ use of the Park Site.
Parks understands and acknowledges that the Authority’s ownership of the Park Site and certain surrounding properties may be subject to regulation by the U.S. Department of Housing and Urban Development (“ HUD”) and that these regulations prohibit the Authority from causing or allowing nuisance conditions at Jordan Downs or the Park Site, including without limitation, graffiti or attractive nuisances.

During the Pre-Development Phase, Developer jointly with Michaels shall be responsible for monitoring any investigation, remediation, mitigation, and/or monitoring (collectively, “Environmental Work”) which may be required by applicable law in, on, under, or around the Park Site in order to develop the Project and have been approved in writing by HACLA.
HACLA shall provide to Developer all testing performed to date with respect to the Park Site and shall collaborate with Developer to determine additional testing and investigation that may be necessary or advisable to undertake during the Pre-Development Phase.
In addition, in accordance with Section 4.14.6 of the MDA, Parks shall require its construction contractor to provide adequate security including the prevention of vandalism, theft, trespassing, dumping and providing the maintenance of secure fencing around the Park Site.
Grading on sites dedicated for park and recreational uses shall not differ greatly from surrounding land and shall be as outlined in the "Public Park Site Standards" attached hereto and made a part hereof as Exhibit A.
Developer shall not itself permit or permit any of its Affiliates, employees, agents, contractors, subcontractors or Third Party Contractors to permit, and such parties shall take all commercially reasonable measures to prevent, the presence, in violation of any applicable law, of Hazardous Materials at, in, on, or under the Park Site.
