Normal Performance definition

Normal Performance has the meaning set out in Clause 27(b)(i).”
Normal Performance in Clause 1 of the Charter shall be amended to read in its entirety: ““Normal Performance” has the meaning set out in Clause 27(b).”

Examples of Normal Performance in a sentence

  • Other than as stipulated by this paragraph, Normal Performance shall not be adjusted (unless adjusted in accordance with paragraph 11(c) below).

  • Normal Performance shall be adjusted according to the results of the ▇▇▇▇▇ Tests as conducted in accordance with the Building Contract, the Specifications and this Charter.

  • As of [date] such [reduced] [increased] Actual Discharge Rate, being [ ] MMScf/day, shall be the [Lowest Performance] [Normal Performance].

  • When measuring the Actual Discharge Rate against Normal Performance, Lowest Performance or Nominated Discharge Rate a variation of ***** percent (*****%) shall be allowed.

  • From that time on, in each case where the Actual Discharge Rate is higher than the then-current Normal Performance during regasification of LNG and discharge of gas over a twenty four (24) hour period without any unplanned shut down in the twenty four (24) hour period, the Actual Discharge Rate shall immediately replace the then-current Normal Performance until subsequently re-adjusted up to a maximum Normal Performance of five hundred (500) MMScf/day.

  • Each such increase in the Normal Performance shall be formalized by signature by both Parties of an addendum to the Charter.

  • Normal Performance or Lowest Performance shall be based upon LNG with a chemical composition pursuant to Appendix 1 of Amendment No. 4.

  • The range of LNG compositions considered for Normal Performance is indicated in the following table.

  • Management Company or PINNACLE may terminate this Agreement “for cause” only upon (a) the deliberate refusal of the Service Company to perform any material obligation under this Agreement, or (b) the Service Company’s failing to meet Normal Performance Standards, which failure shall not have been corrected within a reasonable period of time after written notice from Management Company or from the Department.

Related to Normal Performance

  • Final Performance means the Final Valuation Price divided by the Initial Price(Settlement) each in respect of the Worst Performing Underlying Asset as calculated in respect of the Final Valuation Date. "Final Valuation Date" means 29 November 2027, subject to adjustment.

  • Total Performance means that the entire Work, except those items arising from the provisions of any warranty, have been performed in accordance with the Contract;

  • Substantial Performance means the stage of completion when:

  • Environmental Performance all or any of the following: (a) the consumption of energy and associated generation of greenhouse gas emissions; (b) the consumption of water; (c) waste generation and management; and (d) any other environmental impact arising from the use or operation of the Building or any part(s) of it;

  • Control Performance Standard or “CPS” shall mean the reliability standard that sets the limits of a Balancing Authority’s Area Control Error over a specified time period.
