Examples of Non-Reversionary in a sentence

  • Class Counsel will be solely responsible for distributing any service award to the named Plaintiffs from the All-In Non-Reversionary Fund.

  • If the cost of total Class Benefit, Administration Costs, Attorneys’ Fee and Expense Payment, and service awards exceeds the amount of the All-In Non-Reversionary Monetary Fund, Knix shall pay a Replenishment Amount not to exceed $600,000 to cover the cost of valid claims that would not otherwise be paid.

  • The All-In Non-Reversionary Monetary Fund shall be a nonreversionary common fund, no part of which shall revert to Knix.

  • To the extent that the Class Counsel Fee Order directs that some or all of Class Counsel Fees shall be paid from the Reversionary Amount or Non-Reversionary Payments, the Claims Administrator shall pay such Class Counsel Fees to Class Counsel as directed by that Order from the Trust Accounts.

  • Establishment of Settlement Fund: Defendant will cause to be funded a Non-Reversionary Cash Settlement Fund to be administered by the Settlement Administrator in the amount of $9,000,000.00.

Non-Reversionary means that none of the money in the Settlement Fund will be returned to Apple. Any money remaining in the Settlement Fund after the payments from the Net Settlement Fund to Settlement Class Members as well as payment of attorneys’ fees and costs, and incentive awards to the Class Representatives, will be distributed to one or more of the following organizations upon approval by the Court:

  • Residual Auction Revenue Rights means incremental stage 1 Auction Revenue Rights created within a Planning Period by an increase in transmission system capability, including the return to service of existing transmission capability, that was not modeled pursuant to Operating Agreement, Schedule 1, section 7.5 and the parallel provisions of Tariff, Attachment K- Appendix, section 7.5 in compliance with Operating Agreement, Schedule 1, section 7.4.2 (h) and the parallel provisions of Tariff, Attachment K-Appendix, section 7.4.2(h), and, if modeled, would have increased the amount of stage 1 Auction Revenue Rights allocated pursuant to Operating Agreement, Schedule 1, section 7.4.2 and the parallel provisions of Tariff, Attachment K-Appendix, section 7.4.2; provided that, the foregoing notwithstanding, Residual Auction Revenue Rights shall exclude: 1) Incremental Auction Revenue Rights allocated pursuant to Tariff, Part VI; and 2) Auction Revenue Rights allocated to entities that are assigned cost responsibility pursuant to Operating Agreement, Schedule 6 for transmission upgrades that create such rights.

  • Auction Revenue Rights or “ARRs” shall mean the right to receive the revenue from the Financial Transmission Right auction, as further described in Operating Agreement, Schedule 1, section 7.4, and the parallel provisions of Tariff, Attachment K-Appendix.

  • Auction Revenue Rights Credits means the allocated share of total FTR auction revenues or costs credited to each holder of Auction Revenue Rights, calculated and allocated as specified in Operating Agreement, Schedule 1, section 7.4.3, and the parallel provisions of Tariff, Attachment K-Appendix, section 7.4.3.

  • Academic year means the period of twelve months beginning on 1st January, 1st April, 1st July or 1st September according to whether the course in question begins in the winter, the spring, the summer or the autumn respectively but if students are required to begin attending the course during August or September and to continue attending through the autumn, the academic year of the course is to be considered to begin in the autumn rather than the summer;

  • Sublicense Revenues means all revenue, in whatever form but excluding sublicense royalties, earned by the Licensee in consideration of its granting a Third Party a sublicense to make a Licensed Product including, without limitation, receipt of annual milestone attainment, sublicense issuance, maintenance or up-front payments, or technology access fee; and issuance of securities or real, personal or intangible property.
