The publisher shall, for each textbook ordered, furnish an electronic file in the National Instructional Materials Accessibility Standards (NIMAS) format that will be deposited in the National Instructional Materials Access Center (NIMAC) from which accessible versions of the particular textbook may be produced for students with print disabilities.
The Publisher agrees to prepare and submit, on or before the instructional materials due date for that review cycle in question a NIMAS file set to the NIMAC for every text that complies with the terms and procedures set forth by the NIMAC.
Should the vendor be a distributor of the materials and not the publisher, the distributor agrees to immediately notify the publisher of its obligation to submit NIMAS file sets to the NIMAC.
If the Commission approves the substitution, the publisher agrees to submit an updated version of the program or textbook to the NIMAC for use in the creation of Braille, large print, or other formats for students with print disabilities as indicated in Senate Bill 99 of 2002, section 53A-25a-105.
This is referred to as "the Agreement," while the services WE provide are called "the Services" and the electronic NIMAS file sets available on or from the Web Site described below are collectively called "the Files.” The term "Web Site" means the electronically accessible World Wide Web location for NIMAC and its content, and all Services associated with or part of the Web Site.
Since the NIMAC is authorized and funded by the Federal government, services may be interrupted or discontinued based on action by the Federal government.
