Nielsen will not be liable, in contract, tort (including negligence) or otherwise, for any loss, expense or damage of any kind including, without limitation, special, incidental or consequential damages, due to any failure to provide the Nielsen Data or resulting from any errors or inaccuracies in the Nielsen Data or its use by Publisher or others.
You acknowledge that all intellectual property rights in Nielsen Data are owned by us or (where relevant) our third-party suppliers.
Free access by the Company to Nielsen information assets (including Nielsen Data Services) will be via all means accessible to any client.
Non-syndicated custom formatted guides and reports shall not be Nielsen Data Services, but may be provided to the Company upon request, at a reasonable market price, or at such other price and on such terms as the parties agree.

TCS shall, subject to ▇▇▇▇▇▇▇’▇ approval, establish and maintain environmental, safety and facility procedures, data security procedures and other safeguards against the destruction, loss, unauthorized access or alteration of Nielsen Data in the possession of TCS which are consistent with the obligations and standards provided at Section 5.6 and as are adequate to meet the requirements of ▇▇▇▇▇▇▇’▇ record retention policy and applicable Laws.
In the event Subcontractor shall use Contractor's equipment or facilities, it shall reimburse Contractor at the rates set forth in the latest edition or publication of the Rental Rate Blue Book for Construction Equipment, published by Equipment Guide Book Division, Nielsen Data Quest, unless otherwise agreed in writing or stated herein, plus the cost of all operating labor provided by Contractor in connection with the equipment, and a reasonable markup for overhead and profit.
