Mirati may, in its sole discretion, request Licensee to enroll a number of patients for any Joint Global Study in excess of the applicable Minimum Enrollment Threshold.

The pricing terms in this Agreement are based upon the Minimum Enrollment, Benefit Design (including but not limited to the Formulary), and other information provided by Sponsor to MRx during the proposal process.
Should the School fail to achieve the Minimum Enrollment Level prior to the Opening Date, this Agreement may be terminated by ReGeneration upon 15 days written notice to the School.

The Program Pricing Terms set forth in this Agreement are based upon the Plan Designs, Minimum Enrollment, information/data provided by SPONSOR during or after the proposal/renewal process, and Program specifications agreed to between the parties as reflected in this Agreement, and as otherwise hereafter agreed to by the parties in writing.
