Provisioning The Mass HIway or its LAND Contractor will ship or deliver an Appliance to LAND Participant according to an agreed-to schedule following LAND Participant’s election to use the LAND Services.
LAND Contractor shall ensure such Appliance is configured for remote management to allow for software upgrades installed automatically from a remote site and reinstallation of standard and specialized configuration parameters that will be retained electronically at a remote site to facilitate ready deployment of a replacement unit if necessary.
The LAND Contractor shall provide Tier 2 and 3 technical support to Participant as part of the annual fee.

LAND Participant acknowledges that the source and object code of the Software remains a confidential trade secret of LAND Contractor and/or its licensors and that LAND Participant is not entitled to review either the object code or the source code of the Software for any reason at any time.
