In such a case, Kuwait shall deduct from the taxes so calculated the tax paid in Indonesia but in an amount not exceeding that proportion of the aforesaid Kuwaiti tax which such items of income bear to the entire income.
For purpose of this Agreement, the term “resident of a Contracting State” means: a) in the case of Indonesia, any person who, under the tax laws of Indonesia is liable to tax therein by reason of his domicile, residence, place of management or any other criterion of similar nature; a) in the case of Kuwait, an individual who has his domicile in Kuwait and is a Kuwaiti national, and a company which is incorporated in the State of Kuwait.
It is agreed that double taxation shall be avoided in accordance with the following paragraphs of this Article: a) in the case of Indonesia; (1) where a resident of Indonesia derives income from Kuwait and such income may be taxed in Kuwait in accordance with the provisions of this Agreement, the amount of Kuwaiti tax payable in respect of such income shall be allowed as a credit against the Indonesian tax imposed on that resident.
