Upon any such transfer or substitution of a Financed Student Loan, legal title to and beneficial ownership and control of the related Financed Student Loan File will thereafter belong to the Depositor and the Depositor Eligible Lender Trustee (or KBNA as their designee).
The origination practices used by the originator or KBNA or its predecessor, KBUSA, with respect to the Financed Student Loans have been in all respects in compliance with all applicable laws and regulations.
