Intermediate work means work done during hours which include hours of both day work and night work. In this Agreement, unless the contrary intention appears: • Immediate family includes spouse (including former spouse, defacto spouse, or former defacto spouse), child or adult child, parent, step parent, parent in-law, grandparent, grandchild or sibling of the Employee or spouse of the Employee. • Continuous service for the purposes of Service Pay means all service since the last date of engagement. • A person accredited by VDOT in Intermediate Work Zone Traffic Control must be on-site to provide supervision for adjustment to the approved layout or implementation of any standard Typical Traffic Control (TTC) layouts outlined in the Virginia Work Area Protection Manual.

• If none of the Design-Builder’s on-site personnel responsible for the supervision of such work has the required verification with them or if they have an outdated verification card showing they are not currently verified either by the Department in Intermediate Work Zone Traffic Control, or by the American Traffic Safety Services Association (ATSSA) as a Traffic Control Supervisor (TCS) all work on the project will be suspended by the Department.

• The Design-Builder shall provide at least one person on the project site during all work operations who is currently verified either by the Department in Intermediate Work Zone Traffic Control, or by the American Traffic Safety Services Association (ATSSA) as a Traffic Control Supervisor (TCS).

• The Design-Builder shall have at least one person on the Project site during all work operations who is currently verified either by the Department’s Intermediate Work Zone Traffic Control training or by the American Traffic Safety Services Association (ATSSA) Virginia Intermediate Traffic Control Supervisor (TCS) training by a Department approved training provider.

• Not less than [***] in advance of commencing the Process Intermediate Supply Activities, Amylin and Sandoz will agree upon the final Process Intermediate Work Plan in writing.

• An employee accredited by VDOT in Intermediate Work Zone Traffic Control shall be on-site to provide supervision during work zone adjustments or changes to traffic control due to field conditions.

• Each Member agrees that all Intermediate Work Products received from any other Member or the Consultant shall be held in strict confidence by the receiving Member as allowed by law, and that such information shall be used only for conducting such activities that are necessary and proper to carry out the purposes of this Agreement.

• Each Member shall take all necessary and appropriate measures to ensure that any person who is granted access to any Intermediate Work Products or who otherwise assists the Consultant in connection with this Agreement is familiar with the terms of this Agreement and complies with the terms hereof as they relate to the duties of such person.
