The New Revolving Credit Agreement shall have been duly executed and delivered by the parties thereto in the form of Exhibit 11 and shall be in full force and effect, and no term or condition thereof shall have been amended, modified, supplemented or waived (except for Immaterial Changes) without the prior written consent of each of the Purchasers.
Prior to start of Tenant’s Work or completion of any Immaterial Changes, Tenant will perform the appropriate testing to determine if any asbestosis material exists, and would be disturbed.
