Congress enacted the ICCTA, which effectively deregulated the rail and motor carrier industries, to ensure the economic viability of the two industries.1 As generally interpreted by the courts and the STB – the administrative agency entrusted by Congress to implement and interpret the Act in the first instance – the ICCTA broadly preempts states, and even conflicting federal programs, from adopting rules that affect national railroad transportation.
