The warranty term for each element of the Phase 2 GP Lanes shall commence upon Phase 2 Work Completion.
The Developer may arrange for a contractor to provide such snow and ice removal services at the Developer’s sole cost and expense; provided that, in any case, the Developer and the Developer’s Contractors, as applicable, will not in any way hinder the removal of snow and ice from the GP Lanes.
The Concessionaire will not commence delivery of the Services and the Snow and Ice Control Services in respect of the ▇▇▇▇▇ ▇ ▇▇▇▇▇▇▇ ▇▇▇▇▇ or the Phase 1 GP Lanes (and may not receive Toll Revenues in relation to the Phase 1 Managed Lanes) until the Conditions Precedent to the Phase 1 Services Commencement Date have been satisfied (or HPTE shall have waived such conditions).
Upon the occurrence of the Phase 1 Services Commencement Date, the Concessionaire will commence the delivery of the Services and the Snow and Ice Control Services in relation to the ▇▇▇▇▇ ▇ ▇▇▇▇▇▇▇ ▇▇▇▇▇ and the Phase 1 GP Lanes.
If the Phase 2 GP Lanes have not met the standards set forth in this Section 21 at any time within the warranty period, then the Concessionaire shall correct such work as specified below, even if the performance of such corrective work extends beyond the stated warranty period.
Subject to extension under Section 21.6, the warranties regarding all elements of the Phase 2 GP Lanes shall remain in effect until one year after Phase 2 Work Completion.
If the Developer or the Developer’s Contractors for snow and ice removal damage the GP Lanes, the Developer shall pay to the Department the Department’s Allocable Costs to repair such damage.
The Department will be responsible for maintenance of all soundwalls and noise barriers adjacent to the GP Lanes.
This Section 21.7 shall apply in relation to the Phase 2 GP Lanes.
The Department and the Concessionaire agree and acknowledge that the GP Lanes or any NEXT Department Asset financed by the PABs will be owned, operated and controlled by the State while the PABs remain outstanding and at all times thereafter.
