Examples of Governmental Charge in a sentence
A Party that is exempt at any time and for any reason from one or more Governmental Charges bears the risk that such exemption shall be lost or the benefit of such exemption reduced; and thus, in the event a Party’s exemption is lost or reduced, each Party’s responsibility with respect to such Governmental Charge shall be in accordance with the first four sentences of this Section.
If SCE is required by Applicable Laws to remit or pay Governmental Charges which are Seller’s responsibility hereunder, SCE may deduct the amount of any such Governmental Charge from any amounts due to Seller under this Agreement.
If Buyer is required by Applicable Laws to remit or pay Governmental Charges which are Seller’s responsibility hereunder, Buyer may deduct the amount of any such Governmental Charge from the sum due to Seller under Article 10 of this Agreement.
Any Governmental Charge in respect of any matters related to this Agreement that is imposed on WPS by a Governmental Authority located in Canada shall be the responsibility of, and shall be paid by, MH if WPS would not have been subject to the imposition by such Governmental Authority of a Governmental Charge of this type but for a change in law that occurs after the Effective Date.
Any Governmental Charge in respect of any matters related to this Agreement that is imposed on MH by a Governmental Authority located in the United States shall be the responsibility of, and shall be paid by, WPS if MH would not have been subject to the imposition by such Governmental Authority of a Governmental Charge of this type but for a change in law that occurs after the Effective Date.
Notwithstanding anything contained herein to the contrary, this paragraph shall not be construed to obligate the City to pay any such Governmental Charge.
The Developer has the right before any delinquency occurs to contest or object in good faith to the amount or validity of any Governmental Charge by appropriate legal proceedings properly and diligently instituted and prosecuted in such manner as shall stay the collection of the contested Governmental Charge and prevent the imposition of a lien or the sale or forfeiture of the Property.
Additionally, if the Developer fails to pay any Governmental Charge, the City, in its sole discretion, may require the Developer to submit to the City audited Financial Statements at the Developer's own expense.
If XO decides to impose a new or revised Governmental Charge or Tax, XO will furnish Customer with at least thirty (30) days notice of the new or revised charge or terms and conditions.
In the event such new or revised Governmental Charge or Tax materially and adversely affect Customer’s Service, Customer may discontinue, without any termination or other payment obligation (except for any charges owed for Service up to the time of termination or due third parties), the affected Service by furnishing XO with at least thirty (30) days prior written notice of its intent to discontinue the Service.
