EFW Facility means the energy from waste facility and all supporting infrastructure (including plant and amenities) to be designed, constructed, tested and commissioned pursuant to the Contract; “Environmental Information Regulations” means the Environmental Information (Scotland) Regulations 2004 together with any guidance and/or codes of practice issued by the Scottish Information Commissioner or Scottish Ministers in relation to such regulations;

• The Contractor will be required to apply for and procure the PPC Permit for the EFW Facility.

• The Councils will attempt to reach agreement on a future course of action regarding the use or otherwise of the EFW Facility following expiry of the Contract at least 5 years prior to the expiry of the Contract.

• The EFW Facility Elected Member Engagement Group shall act as an advisory body to the Project.
