DHE Customer definition

DHE Customer means each unique user of the DHE Service authorized by Licensee to receive, decrypt and play a copy of a DHE Included Program from the DHE Service in accordance with the terms and conditions hereof.

  • Additional Technical Credits shall be allowed solely in the event there is no contradicted evidence or behavior suggesting that such DHE Customer has not had a hardware or software malfunction that renders one or more copies of a validly purchased DHE Included Program unviewable or that the Approved Device to which a DHE Included Program was delivered has been replaced or upgraded.

  • Licensee shall not issue Technical Credits in any circumstance where the DHE Customer is able to use the Digital Locker Functionality in compliance with this Agreement to Stream or Electronic Download the applicable DHE Included Program without receiving a Technical Credit from Licensee.

  • Additional Technical Credits shall be allowed solely in the event that such DHE Customer represents, and such representation is not contradicted by evidence or behavior demonstrably available to Licensee, that such DHE Customer has had a hardware or software malfunction that renders one or more copies of a validly purchased DHE Included Program unviewable or that the Approved Device to which a DHE Included Program was delivered has been replaced or upgraded.

  • The “DHE Distributor Price” for each DHE Included Program that is a Television Episode shall be equal to: 70% of the greater of (a) (1) $1.99 if the Television Episode is offered in Standard Definition or (2) $2.99 if the Television Episode is offered in High Definition and (b) the actual amount paid or payable by the DHE Customer (whether or not collected by Licensee) on account of said DHE Customer’s selection of such Television Episode from the DHE Service.

  • For each UV DHE Included Program for which the UV DHE Customer has a Rights Token for Standard Definition rights only (and not High Definition rights), Licensee’s UV Fulfillment shall not be in a resolution higher than Standard Definition.

  • Licensee shall not, pursuant to each UV DHE Customer Transaction and each UV DHE Redemption, distribute or exhibit the applicable UV DHE Included Program to the UV DHE Customer in a non-UV-enabled manner (i.e., via Electronic Download and/or Digital Locker Functionality as provided in the Original Agreement).

  • An Approved Device must be registered to an Account at the time the DHE Customer requests delivery (and in order to receive such delivery) of a DHE Included Program via the DHE Approved Transmission Means to such device.

  • Subject to the foregoing, Licensee’s UV Fulfillment may be in a lower resolution than the resolution in which the applicable UV DHE Included Program was originally acquired if the receiving UV DHE Approved Device is (i) not approved for the higher resolution; or (ii) is approved for the higher resolution but is not capable of receiving and playing a higher resolution, and Licensee provides the relevant UV DHE Customer with adequate notice thereof.

  • For the avoidance of doubt, such Technical Credits shall apply only to file formats and copy protection systems for which DHE Usage Rules do not permit the DHE Customer to maintain multiple or moveable personal copies of the DHE Included Programs.

Related to DHE Customer

  • The Customer means the original purchaser under the purchase agreement.

  • End-Use Customer means a person or entity in Delaware that purchases electrical energy at retail prices from a Retail Electricity Supplier.

  • Customer means the State agency or other entity identified in a contract as the party to receive commodities or contractual services pursuant to a contract or that orders commodities or contractual services via purchase order or other contractual instrument from the Contractor under the Contract.   • End User means, in the event that the Services or Deliverables involve the use of any information systems, any and all UNICEF employees, consultants and other personnel and any other external users collaborating with UNICEF, in each case, authorized by UNICEF to access and use the Services and/or Deliverables.

  • TCP Customers We will not impose Credit Management Charges unless the Charges are a reimbursement of our costs and you are advised of their amount or method of calculation.
