For avoidance of doubt, it is understood and agreed that in-house patent personnel of the Controlling Party shall be deemed Development Personnel with respect to the conduct of the foregoing activities pertaining to the Controlling Party's Technology (i.e., the JT Technology or the CG Technology, as applicable) in accordance with the Development Plan and Budget then in effect.
